1345.01 ENCROACHMENTS PROHIBITED; EXCEPTIONS.
   No person shall encroach upon or in any way obstruct or occupy any street, alley, sidewalk, public ground or land dedicated to public use by placing, building or erecting or causing to be placed, built or erected in, upon or over such street, alley, sidewalk, public ground or land dedicated to public use, any fence, building or structure of any kind whatever, or permit the same to remain when placed, built or erected. However, nothing herein shall prevent signs, awnings and canopies constructed, erected and maintained in accordance with the provisions of the City ordinances. (1964 Code §519.08)
1345.02 ERECTION OF AWNINGS.
   Every awning hereafter set up, erected or maintained over any sidewalk in the City shall be elevated at least seven feet at the lowest part thereof above the sidewalk. Awnings so constructed as to swing with their frames against the building, may project over the sidewalk, not to exceed two-thirds of the width of the sidewalk. Fixed iron awning frames may project not to exceed eight feet over the sidewalk from the inner sidewalk line. Every awning placed or maintained over any sidewalk shall be supported without posts, by iron brackets or proper iron hinges or pivots, with an iron framework firmly attached to the building against which such awning is placed, which framework shall be so made as to swing with such awning against the building. The sidewalk shall be wholly unobstructed thereby. No wooden, or nonmovable awning, awning frame, shed or cover shall be erected or permitted to remain on or over any sidewalk, and no article or merchandise, poster or other article shall be attached to or suspended from any awning or awning frame extending over any sidewalk, nor shall any sign be attached thereto, except such signs as may be printed or painted upon such awning.

1345.03 ERECTION OF CANOPIES AND MARQUEES.
   (a)   A canopy or marquee extending over a sidewalk may be erected and maintained at the entrance of any hotel, church, hall, theater or other edifice where public assemblages of people occur, subject to the following conditions. Any such canopy or marquee shall in no case extend, further than the curbstone in front of such building. It shall not have any of its parts or supports resting upon the sidewalk or street. It shall be at least nine feet in the clear above the sidewalk, and shall not be more than four feet high from its lowest to its highest point.
   (b)   Before any canopy or marquee is erected, application for permission to do so, accompanied with the plans thereof, shall be filed with the Chief Building Official by the owner of the building to which it is attached. Upon the Chief Building Official being satisfied that it is in conformity with this section and will not imperil the public, a permit shall be issued for the erection and maintenance thereof, conditioned that the applicant will save the City harmless from any damage to persons or property by reason of the erection or maintenance of such canopy or marquee, and that the same will be removed at any time upon sixty days' notice from the Chief Building Official to do so.
