§ 158.062 CREATION OF HISTORIC OVERLAY NEIGHBORHOODS; ACTION BY HISTORIC COMMISSION, PLANNING AND ZONING COMMISSION AND CITY COUNCIL.
   (A)   The following historic overlay districts are hereby established and created:
      (1)   Logtown Neighborhood Historic Overlay District, as shown on the map (as attached to Ord. 05-002, passed 2-22-05 and adopted by reference) and which consists of the properties at the following addresses:
         (a)   Broad Street: 1201, 1202, 1204, 1208, 1301, 1304, 1307, 1308, 1310, 1314, 1409, 1410, 1411, 1412, 1414, 1417, 1501, 1502, 1503, 1504, 1505, 1506, 1507

   (B)   For any and all other properties not included in one of the foregoing neighborhoods, designation as a historic property or expansion of a historic district shall not become effective without the affected property owner’s permission, and until recommended by the Commission, the Planning, and officially approved by City Council.
   (C)   A list of all properties designated by City Council as under the jurisdiction of the Commission pursuant to the terms of this chapter shall be maintained by the Building Official.

§ 158.063 IDENTIFICATION ON ZONING MAP.
   Any Camden historic property shall be included in the Historic Overlay District established by § 157.027 of the Camden Zoning Ordinance.

NOMINATIONS OF HISTORIC PLACES
§ 158.075 NOMINATIONS TO NATIONAL REGISTER OF HISTORIC PLACES.
   The Commission may recommend the nomination of buildings, structures, sites, objects or districts to the State Review Board for listing on the National Register of Historic Places after securing owner’s permission. When considering whether a building, structure, site, object or district should be nominated, the Commission should apply the following National Register criteria:
   (A)   The quality of significance in American history, architecture, archeology, engineering and culture is present in districts, sites, buildings, structures and objects that possess integrity of location, design, setting, materials, workmanship, feeling and association, and:
      (1)   That are associated with events that have made a significant contribution to the broad patterns of our history;
      (2)   That are associated with the lives of persons significant in our past;
      (3)   That embody the distinctive characteristics of a type, period or method of construction, or that represent the work of a master, or that possess high artistic values, or that represent a significant and distinguishable entity whose components may lack individual distinction; or
      (4)   That have yielded, or may be likely to yield, information important in prehistory or history.
   (B)   The Commission shall conduct first review and evaluation of all proposed National Register nominations within its jurisdiction, including any which may have been submitted to the State Historic Preservation Office, hereinafter SHPO, and shall forward all reviewed nominations to the SHPO with recommendations for consideration by the State Board of Review. The Commission shall not have the authority to nominate properties directly to the National Register. Nomination for National Register status shall not be made to SHPO by the Commission without the property owner’s permission.

PERMITTED USES; MAINTENANCE
§ 158.085 PERMITTED USES.
   Any building, group of buildings, structures or objects which constitute non-conforming structures pursuant to the zoning ordinance of the city and which fall under the jurisdiction of the Commission may be repaired or restored in accordance with the criteria for rehabilitation as set forth herein and must be reconstructed on the original foundation site after receiving a certificate of appropriateness issued by the Commission. Any non-conforming structure which is expanded, enlarged, repaired, restored or reconstructed pursuant to a certificate of appropriateness, must conform to all applicable fire and safety codes. Otherwise, the city’s zoning ordinance will govern all land use and structures and/or subdivision for conforming historic properties.

§ 158.086 MAINTENANCE AND REPAIR.
   This chapter shall not prevent ordinary maintenance or repair to the exterior of a historic property as long as it does not change the material, design or outer appearance of the property. The construction, reconstruction, alteration, or demolition of an exterior feature shall be allowed if it is certified as required by the Building Official or similar official because of an unsafe or dangerous condition.

CERTIFICATE OF APPROPRIATENESS
§ 158.095 ISSUANCE.
   (A)   Prior to the issuance of a building permit for the purposes of any demolition, new construction, alteration, modification, or addition to a historic property, a certificate of appropriateness from the Commission shall be required. Any building permit or other permit not issued in conformity with this section shall be considered void. The penalties provided for violations of the building code will apply to violations of this chapter.
   (B)   The certificate shall be a standard form, signed by either the Chairman or the Vice-Chairman of the Commission, stating that the requested demolition, moving, or change to the exterior appearance of a structure is approved by the Commission. Application for a certificate of appropriateness must be made by the owner of the property or by his or her authorized representative or agent. Action relating to applications for a certificate of appropriateness must be taken by the Commission within 45 days of receipt by the Commission of complete and proper applications for a certificate of appropriateness. The Building Official is authorized to issue a certificate of appropriateness for maintenance and repair, as described in this chapter, without approval by the Commission.
