139.01 APPOINTMENT, TERM AND QUALIFICATIONS; COMPENSATION.
   (a)   The Director of Public Safety shall be a full-time position and subject only to Section 8.01 of the City Charter.

   (b)   Compensation of the Director of Public Safety shall be fixed by Council.
139.02 GENERAL DUTIES; RECORDS AND CONTRACTS.
   (a)   Under the direction of the Mayor, the Director of Public Safety shall be the executive head of the Police and Fire Departments, and the chief administrative authority of the charity, correction and building departments. He shall have all powers and duties connected with and incident to the appointment, regulation and government of such departments, except as otherwise provided by law. He shall keep a record of his proceedings, a copy of which, certified by him, shall be competent evidence in all courts.
   The Director shall make all contracts in the name of the City with reference to the management of such departments, for the erection or repair of all buildings or improvements in connection therewith, and for the purchase of all supplies necessary for such departments.

   (b)   The Safety Director shall manage, coordinate and organize all operations of the Department of Airport Relations and Community Assistance. The Director shall develop and implement programs and provide services as necessary to accomplish the purposes of the Department as set forth in Section 181.02, which may include, but is not limited to, the following:
      (1)   Consult with residents, City officials and Cleveland representatives on all matters relating to documents relating to the Residential Acquisition Program or the Settlement Agreement received from the City of Cleveland, including but not limited to the following:
         A.   Notice of Residential Acquisition Program;
         B.   Election agreement to participate in Residential Acquisition Program;
         C.   Confirmation of participation in Residential Acquisition Program;
         D.   Notice of acquisition;
         E.   Appraisal(s); and
         F.   Written offer(s) from the City of Cleveland for the acquisition of residential property and for relocation assistance.
      (2)   Prepare and distribute educational and informational material to assist residents to understand the Residential Acquisition Program.
      (3)   Compile and maintain, together with Cleveland and the Director of Law, the Approved Appraiser List provided for in Paragraph 9.9 of the Settlement Agreement.
      (4)   Provide assistance to residents in evaluating Cleveland's offer to acquire residences, including appraisal information received from Cleveland. Such assistance shall include attendance as requested at meetings and consulting with residents regarding the appraisal process, and assistance in obtaining, if requested by the resident, an independent appraisal of residential property as provided in Paragraph 9.9.2 of the Settlement Agreement.
      (5)   Attend meetings or conferences with residents, the Cities of Brook Park, Cleveland and/or the FAA as may be necessary during the acquisition process.
      (6)   Provide assistance in obtaining mortgage finance assistance for residents in need.
      (7)   Provide assistance to residents affected by the Residential Acquisition Program in making arrangements to move their personal belongings, including providing a list of prescreened moving companies, assistance in obtaining bids from moving companies, information regarding reimbursable moving and relocation expenses, and assistance in filing for reimbursements.
      (8)   Provide transportation assistance within 50 miles of Brook Park for elderly and handicapped residents affected by the Residential Acquisition Program.
      (9)   Provide assistance as necessary to residents affected by the Residential Acquisition Program in locating suitable replacement housing and filing the appropriate documents with the City of Cleveland to obtain reimbursement for all eligible expenses.
      (10)   Provide assistance as necessary to residents relocating pursuant to the Residential Acquisition Program in notifying utility companies, physicians, insurance companies and banks.
      (11)   Provide assistance as necessary to residents affected by the Residential Acquisition Program in obtaining storage.
      (12)   Provide assistance as necessary to residents affected by the Residential Acquisition Program in evaluating any offer of a replacement housing payment, which program may include assisting the resident in identifying appropriate replacement housing and, to the extent permitted by the Settlement Agreement, assistance in appealing any offer of a replacement housing payment.
      (13)   Work with the Director of Law, City Engineer and Finance Director to provide for the completion of Aerospace Parkway.
      (14)   Establish a program to monitor Cleveland's compliance with the Settlement Agreement.
      (15)   Establish a program to monitor Brook Park's compliance with the Settlement Agreement, including, without limitation, its obligation to cooperate with and not interfere with Cleveland in carrying out the Residential Acquisition Program as provided in Paragraph 9.9 of the Settlement Agreement.
      (16)   Draft, implement and enforce appropriate policies, including personnel policies, for the Department.
      (17)   Maintain records on all residential parcels in the Expansion Zone as defined in Paragraph 1.17 of the Settlement Agreement.
      (18)   Provide monthly reports on the status of each residential parcel in the Expansion Zone as defined in Paragraph 1.17 of the Settlement Agreement.
      (19)   Provide a list of residential parcels to be removed from the Tax Credit Program (Ord. No. 8828-2001) semi-annually.
      (20)   Provide to the Mayor a budget for any and all part-time support or consulting services the Director determines to be necessary, including, without limitation, hiring review appraisers, retaining community outreach, providing informational materials and associated printing costs.

139.03 POLICE AND FIRE CLASSIFICATION; RULES AND REGULATIONS.
   The Police and Fire Departments shall be maintained under the civil service system.
(ORC 737.11).
   The Director of Public Safety shall classify the service in the Police and Fire Departments in conformity with the ordinance of Council determining the number of persons to be employed in the Departments, and shall make all rules for the regulation and discipline of such Departments, except as otherwise provided by law.

139.04 EMERGENCY PATROLMEN AND FIREMEN.
   In case of riot or other like emergency, the Mayor may appoint additional patrolmen and officers for temporary service in the Police Department, or additional firemen and officers for temporary service in the Fire Department, who need not be in the classified list of such Departments. Such additional persons shall be employed only for the time during which the emergency exists.
