No department of the village shall accept, lay out, open, improve, grade, pave, curb or light any street or other way, unless such street or way:
(A) Shall have been accepted or opened or otherwise shall have received the legal status of a public street or way prior to the effective date of this subchapter; or
(B) Unless such street or way shown on a recorded plat which shall have been legally accepted by Council of the village.

It shall be unlawful for any person, other than the Street Superintendent, Village Engineer or the authorized employees or agents of either, to make any opening in any street, alley, sidewalk or public way of the village unless a permit to make such opening, shall have been obtained prior to commencement of the work, as herein provided. OPENING shall include test holes.

Permits for making openings in the village right-of-way shall be issued by the Street Superintendent. Applicants for opening permits shall provide such information as the village may reasonably require, as called for in the permit application. The permit shall only be issued after the payment by the applicant of a fee in an amount sufficient to cover the cost and expense of the Village Street Superintendent in inspecting and supervising the restoration of the right-of-way. Public utilities shall not be required to pay for such fee.

(A) The extra work of restoration, including backfill, paving base and paving surface, shall be carried out under the directions and satisfaction of the Village Street Superintendent.
(B) The quality shall be not limited to, but including the following.
(1) Ditch openings inroad surfaces shall be evenly cut and without ragged edges.
(2) All roadway and berm areas shall be backfilled with limestone. Limestone size shall be one- fourth inch to one inch in diameter. Thickness shall be a minimum of three inches to the surface.
(3) An oil based seal will be applied to the edges of the opening before a permanent patch is installed.
(4) Street and public ways must be properly compacted in uniform layers of four inches of material.
(5) Utilities which are required to excavate in an emergency shall be required to apply for an opening permit within 24 hours after the commencement of the excavation.

Any person engaged in or employing others in excavating, or opening any street, sidewalk, alley or other public way, shall have such excavation or opening fully barricaded at all times to prevent injury to persons or animals.

Any person engaged in or employing others in excavating or otherwise in any manner obstructing a portion or all of any street, sidewalk, alley or other public way, at all times during the night season shall cause at least two illuminated lights to be surely and conspicuously posted on, at or near each end of such obstruction or excavation, and if the space involved shall exceed 50 feet in extent, then at least one additional lamp for each added 50 feet or portion thereof excavated or obstructed.

It shall be unlawful for any person to unload any heavy material in the streets of the village, by throwing or letting the same fall upon the pavement of any street, alley, sidewalk or other public way, without first placing some sufficient protection over the pavement.
