AUCTIONS AND AUCTIONEERS
§ 113.170 LICENSE REQUIRED.
   No person shall exercise within the limits of the city the business or trade of an auctioneer or sell at public auction any goods, wares, merchandise or chattels without having obtained a license for that purpose. However, nothing herein contained shall apply to any ministerial officer selling by virtue of his or her office.

§ 113.171 BOND.
   No person shall receive a license to sell goods at auction within the city until such person has executed to the city a bond, to be approved by the Mayor, in the penal sum of $1,000, with two or more sureties residing within the city, conditioned for strict observance of all ordinances of the city pertaining to auctions and auctioneers, requiring licenses to expire on the April 30 next after the date of issuance, and giving the Mayor power to revoke the license when satisfied of the fact of violation of any ordinance.

§ 113.172 CLASSES OF LICENSES; FEES.
   (A)   Auctioneer’s licenses shall be of the following classes.
      (1)   A Class “A” daily license shall entitle the licensee to undertake the business or trade of an auctioneer or sell at public auction for not more than one day. The license fee for a Class “A” license shall be $25 per license.
      (2)   A Class “B” license shall entitle the licensee to undertake the business or trade of an auctioneer or sell at public auction on a yearly basis; the license to expire on the April 30 next after the date of issuance. The license fee for a Class “B” license shall be $300 per license.
   (B)   Class “A” and “B” licenses shall be mutually exclusive.

§ 113.173 DECEPTION OF BIDDERS PROHIBITED.
   Whoever shall exhibit and offer for sale at auction any article and shall induce its purchase by any bidder and shall afterward secretly substitute any other article for the one so exhibited with intent to deceive and defraud the bidder; or whoever shall, while engaged in or about the making of an auction sale, be guilty of any device or trick or other fraudulent practice with intent thereby to deceive or defraud the bidder, upon conviction thereof, shall be fined an amount as provided in § 10.99 of this code of ordinances.
