147.01 WORK POLICY FOR NON-DEDICATED AND/OR PRIVATE ROADS.
Council authorizes the Department of Public Services to enact a work policy for non- dedicated and/or private roads by the Department of Public Services to be approved by Council and reinforced by the Director of Public Services, under the following terms:
(a) Department of Public Services shall not engage in service contracts with individual residents and/or homeowner associations.
(b) The following private roads shall be considered separate and apart from other non-dedicated streets and shall be “grandfathered in” as dedicated streets: Fairview Lane, Hanes Road, Jackson Road, Kimberly Lane. The dedication of these streets is contingent upon 100% of the property owners abutting the streets offering the street right-of-way to the City of Aurora. At the time the petition offering the right-of-way is filed, the petition must stipulate the road right-of-way which must be a minimum width of 20' and the total right-of-way width which shall be in an amount as determined by the Director of Public Services in his sole discretion to be necessary for maintenance, drainage or ditching.

147.02 IMPROVEMENT AND/OR MAINTENANCE SERVICES TO UNDEDICATED PROPERTY.
Services for improvement (other than snowplowing services) shall generally be provided only to dedicated property within the City. However there may be an occasion when City services may be provided to non-dedicated property that meet the following, as a minimum requirement. The City may request additional requirements:
(a) Is indeed a rare and unusual situation.
(b) City shall have the sole discretion on whether the service can be provided.
(c) Is a petition request to City Council subscribed by owners of sixty percent (60%) of the front footage abutting the improvement.
(d) Is in the common good of the residents of Aurora.
(e) City is held harmless, improvement and/or maintenance is provided on “best effort basis”.
(f) Funds are available for the improvement.
(g) The request is approved by a super majority of City Council, greater than two-thirds vote.
