147.02 IMPROVEMENT AND/OR MAINTENANCE SERVICES TO UNDEDICATED PROPERTY.

   Services for improvement (other than snowplowing services) shall generally be provided only to dedicated property within the City. However there may be an occasion when City services may be provided to non-dedicated property that meet the following, as a minimum requirement. The City may request additional requirements:

   (a)   Is indeed a rare and unusual situation.

   (b)   City shall have the sole discretion on whether the service can be provided.

   (c)   Is a petition request to City Council subscribed by owners of sixty percent (60%) of the front footage abutting the improvement.

   (d)   Is in the common good of the residents of Aurora.

   (e)   City is held harmless, improvement and/or maintenance is provided on “best effort basis”.

   (f)   Funds are available for the improvement.

   (g)   The request is approved by a super majority of City Council, greater than two-thirds vote.
