If not already completed, the developer, their successors or assigns, if any, shall construct, at their cost, all main sanitary sewers for service to property within the Jordan Creek Crossing II specific plan at the time that any portion of the property is being developed. Construction of these utilities shall be in accordance with the requirements of the city of West Des Moines subdivision ordinance and the Des Moines metro standards. No occupancy permits, either temporary or permanent, will be issued until all public improvements are either installed and accepted by the city council or properly bonded for as determined by the public works department.
If not already completed, the developer, their successors or assigns, if any, shall construct, at their cost, all water mains for water service to property within the Jordan Creek Crossing II specific plan as required by West Des Moines waterworks at the time that any portion of the property is being developed. This requirement includes all water mains as indicated for property included within the Jordan Creek Crossing II specific plan area, as well as all mains in street rights of way adjacent to the specific plan property. The sizes of all water mains shall be determined by the waterworks department. Water mains shall be constructed along the entire street frontages of the specific plan area. No occupancy permits, either temporary or permanent, will be issued until all public improvements are either installed and accepted by the waterworks board or properly bonded for as determined by the waterworks department.
Nothing in this ordinance shall be construed to prevent the developer, their successors or assigns, if any, from entering into private agreement(s) as they may desire to share the cost of the installation of water, sanitary sewer, and/or storm water infrastructure. (Ord. 1739, 3-26-2007)
