With the first development proposal for the rezoned property as acted upon herein and legally described in section 072-01 of this ordinance, proper action shall be taken to establish a master property owners' association with said property into the South Maple Grove Property Owners' Association and all building restrictions, covenants, and other associated conditions attached to the South Maple Grove PUD shall be made to also apply to said property. The South Maple Grove Property Owners' Association shall be responsible for the ongoing upkeep and maintenance of any privately owned common grounds, structures, signs, etc., as outlined in the association documents and any other specific development improvements noted as their responsibility in this ordinance.
The developer shall, with the approval of the city council, adopt building restrictions, easements, and covenants pertaining to the property where the developer and the city deem appropriate. (Ord. 1610, 10-25-2004)
