At time of subdivision platting within the GreenWay Crossing PUD, the subdivider shall be responsible for construction and/or installation of all required public infrastructure improvements in accordance with the city's subdivision ordinance, and as indicated on the approved GreenWay Crossing PUD sketch proposal. With any subdivision plat within the GreenWay Crossing PUD, the subdivider shall be responsible for constructing and/or installing the public infrastructure necessary to support development within the subdivision in a manner that will assure that the public infrastructure functions at an acceptable level of service (per the city's comprehensive plan) and that complies with all city ordinances.
A. At such time of platting or development, the petitioner proposing said platting and/or development shall be responsible for:
1. Construction of 91st Street, from University Avenue to Bishop Drive: A thirty one foot (31') wide street shall be constructed (2 lanes) and will be a private street.
2. Construction of 90th Street adjacent to parcels J, K and L: A twenty six foot (26') street shall be constructed.
3. Construction of 90th Street adjacent to parcels C, D, E, F, and G: A thirty seven foot (37') street shall be constructed.
4. Construction of 88th Street from University Avenue to the south boundary of this PUD: A thirty one foot (31') wide street (2 lanes) shall be constructed.
5. Construction of Bishop Drive from 92nd Street to 88th Street: A thirty seven foot (37') wide street shall be constructed (3 lanes).
B. At such time of platting or development of any parcel or portion of the area contained within the GreenWay Crossing PUD, the petitioner proposing said platting and/or development shall deed to the city:
1. The applicant shall dedicate sixty feet (60') of right of way from the centerline of University Avenue on the property adjacent to University Avenue in fee title. In addition, the applicant shall provide to the city an irrevocable offer of right of way dedication for the property adjacent to University Avenue in this development. The amount of right of way to be dedicated in said irrevocable offer shall be 22.5 additional feet for a total of 82.5 feet. At such time the city determines it is necessary, the applicant shall dedicate 22.5 additional feet of right of way to the city in fee title.
2. Additional 92nd Street ROW necessary to provide sixty feet (60') of ROW from the centerline of street.
3. Sixty feet (60') of ROW for 91st Street.
4. Sixty feet (60') of ROW for 90th Street adjacent to parcels J, K and L.
5. Seventy feet (70') of ROW for 90th Street adjacent to parcels C, D, E, F, and G.
Note: There will be a ROW transition from sixty feet (60') to seventy feet (70') which will parallel the street transition from twenty six feet (26') to thirty seven feet (37'). This will occur between parcel J and the intersection of Bishop Drive and 90th Street.
6. Sixty feet (60') of ROW for 88th Street.
7. Seventy feet (70') of ROW for Bishop Drive.
C. To provide logical and orderly development within the PUD, allowable street access locations are defined on the PUD plan. All development within the PUD shall comply with the allowable access locations indicated on the PUD plan.
1. Access to 92nd Street shall be permitted at the following locations only:
Bishop Drive.
Private driveway approximately nine hundred feet (900') south of Bishop Drive.
2. All access points to the public street not divided by a median will need to align with existing driveway across the street (no staggered driveways).
3. Driveway locations on parcels E, F, G, and H between 92nd Street and 90th Street need to be one hundred fifty feet (150') measured from the centerline of the public street intersections.
4. Driveway locations on parcels E and F need to be one hundred fifty feet (150') minimum from the street intersection of 88th Street/Bishop Drive and 90th Street/Bishop Drive. (Ord. 2018, 1-13-2014)
