The property may be subject to future area-wide assessments, including, but not limited to, the reconstruction, construction, widening, and/or improvements to Ashworth Road and 74th Street, as shall be permitted and limited by the laws of the State of Iowa to be observed by municipalities.
A. Ashworth Road And 74th Street: With respect to any future assessments by the City of West Des Moines of special benefits conferred upon Parcel 1, 2 and 3 of the property, or any portion thereof, as a result of the repaving and widening of that portion of Ashworth Road and 74th Street that provides access to said property, the owner, on behalf of itself and its successors and assigns (collectively by the "owner"), agrees that such assessments may be spread against all of said parcels, as said parcels exist on the date of assessment, by the City of West Des Moines on an area basis.
B. Water Service Improvements: With respect to any assessments by the City of West Des Moines of special benefits conferred upon Parcels 1, 2, and 3 of the property, or any portion hereof, as a result of the design and construction of potential area wide water service improvements as determined by engineering studies approved by the City of West Des Moines, the owner, on behalf of itself and its successors and assigns (collectively by the "owner"), agrees that such assessments may be spread against all of said parcels, as said parcels exist on the date of assessment, by the City of West Des Moines on an area basis.
