It is known that some site improvements, including, but not limited to, landscaping, signs, stormwater basins, irrigation equipment and other minor appurtenances fall within the ultimate rights of way for adjoining public streets. It is agreed that such improvements may remain until such time that the public streets are to be widened and it is determined that the structures/improvements are in the way. Removal of said structures/improvements shall be by the developer of the shopping center and not the city and the city shall not provide payment for these structures/improvements nor reimburse any cost to remove said structures/improvements. Furthermore, should repair or replacement of the utilities within the ultimate street rights of way cause damage to said structures/improvements, it shall be the responsibility of the developer to repair such damage to said structure/improvements at the developer's expense.
