A. Property Owners' Association: The subdivision of any area within the PUD shall require the formation of a property owners' association. And, the developer, their successors and assigns, if any, shall provide the city with acceptable documentation providing that all properties within the PUD shall belong to the property owners' association which will be responsible and liable for the ownership and maintenance (all costs associated with) of all private streets, private drives, parking areas, and common open space areas, including any required landscaping of open space or parking areas within the PUD. For all perpetuity, this agreement shall run with and be filed against the title of all parcels within the PUD.
B. Access: On the sketch plan, it should be noted that the entire PUD does not have any public street frontage. In order to comply with the intent of the city code requirements for public street frontage for any proposed lots, at the time of platting there shall be cross access easements, and cross parking agreements established, if applicable, throughout the PUD which shall ensure perpetual access to those properties without public street frontage. The property owners' association shall be responsible for the long term maintenance and reconstruction of internal drives utilized by the multiple lots. It shall also be the responsibility of the property owners' association to maintain access via the private streets and drives within the development to those parcels without public street frontage and the city shall not have any responsibility in providing for public street frontage access for any of the parcels within the PUD.
