A. Grand Avenue: With respect to any future assessments by the city of West Des Moines of special benefits conferred upon parcels A, B, C, C-1, C-2, E, F and G of the property, or any portion thereof, as a result of the initial paving and widening of that portion of Grand Avenue that provides access to said property, the owner, on behalf of itself and its successors and assigns (collectively by the "owner"), agrees that such assessments may be spread against all of said parcels, as said parcels exist on the date of assessment, by the city of West Des Moines on an area basis.
B. Water Main Extension: With respect to any future assessments by the city of West Des Moines of special benefits conferred upon parcels A, B, C, C-1, C-2, E, F and G of the property, or any portion thereof, as a result of the construction and installation of public water mains along South 50th Street and Grand Avenue to serve the area and said property, the owner, on behalf of itself and its successors and assigns (collectively by the "owner"), agrees that such assessments may be spread against all of said parcels, as said parcels exist on the date of assessment, by the city of West Des Moines on an area basis.
The foregoing area assessment provisions are subject to the following provision: Any assessment shall be reasonable and equitable in comparison to the special benefits for such initial paving and widening assessed against the property. (Ord. 1252, 6-16-1997)
