In addition to the general criteria as stated above, the following land use regulations, development standards, and design criteria shall apply to the development of all areas designated on the Sketch Plan:
All general use regulations and provisions set forth in title 9, "Zoning", of the City Code for General Industrial (GI) Zoning District shall apply to any development proposal for the property, unless noted otherwise in this ordinance.
A. Uses: The following three (3) land uses will be allowed within the PUD, any other land use proposed for the PUD in the future will need to be reviewed and approved through the Plan and Zoning Commission and City Council under a rezoning review.
1. Commercial Kitchen: This use will be a kitchen-only use under eating places (SIC 5812). The commercial kitchen is intended to provide food preparation equipment for up to sixteen (16) food trucks operating out of the kitchen and may serve patrons of the planned beer hall. Office space that is ancillary to the kitchen and is a part of the business operations of the kitchen shall be allowed. Gardens for the production of food to be used in the commercial kitchens or donated may be allowed within the site. Said gardens shall not be rented to entities not utilizing the commercial kitchen for food preparation.
2. Distillery: This use will be allowed as a permitted use under the manufacturing of beverages (SIC 208). Tap rooms/tasting rooms/or space devoted to on premises consumption of spirits beyond the sampling of the product shall adhere to State of Iowa regulations. Office space that is ancillary to the distillery and is a part of the business operation of the distillery is allowed.
3. Beer Hall: This use will be considered a bar or drinking place under drinking places (SIC 5813) and will require the review of a permitted conditional use permit application. The permitted conditional use application will be reviewed by the Board of Adjustment. Office space that is ancillary to the beer hall and is a part of business operations of the beer hall is allowed.
B. Building Setbacks: Building setbacks for principal and accessory structures shall be measured from the ultimate right- of-way line for property lines abutting a public street or the property lines in all other cases.
C. Outdoor Use Areas: The intent of these provisions is to limit the noise and light impact to the residential uses that are within three hundred feet (300') of the principal building or the edge of the patio or outdoor use area, whichever is more restrictive. Patios and other gathering areas outdoors will be allowed with the following conditions:
1. Sound from televisions, speakers, or the like placed on the patio which is audible to any residential property is not allowed. No live amplified music (bands), not otherwise approved as part of a temporary use permit, is allowed. Lights of televisions, video screens, signage within the patio, etc., shall not be visible to any residential property.
An application for temporary use permits may be submitted to the City for the use of the area to the south and east of the principal building, subject to meeting the conditions and requirement of the permit.
2. No overhead or garage-type doors (full or partial height) or windows, sliding doors or windows, or other openings for the purpose of remaining open for the serving of food or beverages, the transfer of music, the use of video monitors, or other such uses, shall be installed on the north facade.
3. Patios and other outdoor spaces for patrons or employees on the north side of the principal building shall be buffered with solid screening, such as glass, to mitigate sound transfer to a height of eight feet (8') at the time of construction of the patio or outdoor area and prior to its use for patrons and employees.
D. Temporary Use Permits: Other planned activities/events on the property that are not part of the typical activities of the distillery, beer hall, or commercial kitchen, and which are limited in duration and do not create anticipated significant impacts to nearby property, City property or right-of-way will require the submittal of and be subject to the regulation of title 9, chapter 16, "Temporary Use Permits", of the City Code. Adequate infrastructure, including provision of parking, must be provided on site unless otherwise approved by the City Council. The Director of Development Services shall reserve the right to present any temporary use permit request to the City Council for approval.
E. Mobile Vending Permits: The outdoor operation of food trucks vending food and beverages on the property shall be governed by title 3, chapter 7, "Solicitors And Mobile Food Units", of the City Code. (Ord. 2206, 3-20-2017)
