In order to maintain the functional class of the city's roadway system as set forth in the comprehensive plan, the right of way necessary for Grand Avenue shall be provided by the developer. An irrevocable offer of right of way dedication shall be provided at the time of the PUD, with actual dedication of the right of way to occur in conjunction with the installation of Grand Avenue improvements or submittal of a major modification application for the True Value site. The developer shall provide at no cost to the city temporary easements necessary for the construction of public streets within or adjacent to the development. The city will endeavor to structure the construction of the public improvements in such a manner as to minimize the impact on the business operations of the businesses within the 1st Street Redevelopment area.
