In addition to the general conditions requirements stated within this document, the following land use design criteria shall apply to the development areas designated by parcel on the sketch plan.
A. Parcels A And B: All general use regulations and provisions set forth in title 9, "Zoning", of the West Des Moines city code for the regional commercial district (RC), shall apply to any development proposal for any of these parcels as shown on the sketch plan for the PUD ordinance, unless noted elsewhere within this ordinance.
1. Uses:
a. The following uses shall be limited to a maximum of thirty four thousand (34,000) square feet in accumulation between the two (2) PUD parcels:
SIC 5812 | Restaurants. |
SIC 5813 | Drinking places. |
b. The following uses will be permitted uses:
SIC 60 | Freestanding ATM (formerly a Pc use). |
SIC 7999 | Indoor golf. |
c. The following shall be prohibited:
SIC 541 | Convenience stores. |
SIC 554 | Gasoline service establishments, with or without repair. |
2. Building Setbacks: Building setbacks shall be measured from the ultimate right of way line for property lines abutting a public street and from the property line in all other cases.

Notes:
1. Setback of 0 feet allowed if the property abuts a similar district.
2. For each additional 10 feet of setback, an additional 12 feet of height will be allowed.
3. If the existing parking lot encroaches into the required parking setback from the ultimate right of way line, at the time of the reconstruction of University Avenue or 28th Street, the setback will be 7 feet to accommodate vehicle overhang and screening landscaping from the sidewalk to the curb of the parking lot. If any part of the building adjacent to the parking lot in this situation is to be razed, the parking lot setback will be 15 feet from the ultimate right of way line at that time. Any parking spaces that may be lost due to the reconstruction of University Avenue and/or 28th Street will not be required to be reconstructed.

3. Outdoor Use Areas: Outdoor use areas, i.e., sitting and gathering areas shall be encouraged.
4. Screening: Vegetation or other measures, with or without berming, shall be required to provide opaque screening of all parking areas, dumpsters, mechanical equipment, etc., from view from all streets (public and private) and adjoining properties adjacent to the PUD boundary.
