Exhibit A identifies the Grand Avenue redevelopment district street network and general accesses as it relates to the West Bank-Casey's PUD area.
A. Existing Public Streets:
1. See exhibit A for illustration of public street lane configuration.
B. Future Public/Private Streets: The design of all other roads within the area and adjacent to parcels A and B of this PUD, other than Grand Avenue and 1st Street, shall be consistent with the recommendations of the traffic analysis (city of West Des Moines, dated November 15, 2011) and the following:
1. These roads may be public or private in ownership.
2. Lane configuration shall be as identified in the traffic analysis.
3. Adequate sight distances shall be maintained at all intersections to allow vehicles and pedestrians approaching intersections to identify and anticipate potential interaction and conflicts with other vehicles and pedestrians.
4. No road closures are allowed regardless if private or public without prior permission of the city of West Des Moines.
5. Future streets located along the north and west sides of West Bank-Casey's PUD whether public or private, are intended to be constructed prior to, or concurrent with, the widening of Grand Avenue and the installation of medians.
6. It is the intent of the developer and the city that any private roads within the Grand Avenue redevelopment plan area shall not subsequently be conveyed to the city as public streets but shall remain private in perpetuity.
7. All private streets shall be maintained and function (including timely snow removal) in a fashion similar to the public expectations of a public street. The developer and the city shall execute a public access easement at the time of street construction in which the rights and responsibilities of the parties shall be delineated.
C. Signalized Intersections: Traffic signals may be allowed at the intersection of Grand Avenue and the future north-south street located immediately adjacent to and west of the West Bank- Casey's PUD area at such time when traffic warrants as determined by the city. The city may facilitate installation of this signal, but the city shall have no responsibility for any cost of installing this signal. Dedication of permanent right of way to accommodate the placement of signals and appurtenances shall be provided to the city upon request by the city and at no cost to the city. Temporary construction easements shall also be provided at no cost to the city.
D. Site Access:
1. Grand Avenue:
a. A permanent access drive to the West Bank-Casey's PUD area from Grand Avenue shall be allowed and located no farther to the west than where half of the westbound left turn lane for the future north-south street along the western PUD boundary is developed (approximately 180 feet from the nose of median to centerline of the driveway). Initially, this access will allow for full turning movements; however, at such time that a median is constructed on Grand Avenue; the access shall be restricted to a right in/right out access only.
b. A temporary access drive to parcel A (West Bank) off of Grand Avenue shall be allowed until such time that a street is constructed along the western PUD boundary. A permanent secondary access into parcel A will be located off of this western street. Upon construction of the street along the west and creation of an access into parcel A, the Grand Avenue access will be closed completely. The property owner of parcel A shall be responsible for constructing the access drive connection to the west street. It is intended that this western street will be constructed prior to or in conjunction with the widening of Grand Avenue and the installation of medians.
2. 1st Street: Access from 1st Street shall be provided immediately north of the West Bank-Casey's PUD area within the existing city of West Des Moines property and as generally depicted on the PUD sketch plan (exhibit A). The developer of parcel B shall be responsible for constructing this access so as to provide city required secondary access into parcel B. Maintenance of this access shall be by the owner of parcel B until such time that the future road along the north is constructed and said road determined to be public or private and ongoing maintenance responsibilities are defined. The city shall grant the necessary temporary construction easements to allow for the initial construction and ongoing maintenance of the access drive.
3. Future Streets: Future streets shall be constructed along the western and northern boundaries of the West Bank-Casey's PUD as shown on the sketch plan on file in the city. Said streets may be public or private. At such time as said streets are constructed, additional accesses into the West Bank-Casey's PUD area may be provided off these streets at locations determined to be acceptable to the city.
