In order to maintain the functional class of the city's roadway system as set forth in the comprehensive plan, the right of way necessary for Grand Avenue shall be dedicated to the city in fee title. 1st Street right of way may remain in a right of way easement with the exception of that necessary to accommodate traffic signals and associated utilities shall be dedicated in fee title. In accordance with right of way standards for each road classification consistent with the city's comprehensive plan or as otherwise defined in this ordinance, the developer(s) shall provide the necessary easement and dedication at the time of development for that property to which they have authority over. A condition of approval will require the eventual dedication of approximately one thousand five hundred (1,500) square feet of property necessary for improvements to Grand Avenue which is not currently under the authority of the developers. Because ownership of the land is different than ownership of the improvements, a separate agreement will be negotiated with the developer to provide for acquisition of the right of way.
