A. Site Plan: The current Dallas County approved mining plans for each of the two (2) quarry sites as updated to reflect current and intended mining operations in light of recent road information and requirements within this PUD shall be considered adequate site plans. No traffic study or stormwater management plan shall be required. Site plans shall require the approval of the city council upon review and recommendation of the plan and zoning commission. Upon approval, the site plans for quarry operations shall take the place of the county issued mining permits. Unless otherwise provided for within this ordinance, the site plans shall be considered entitlement to operate until December 31, 2043. All extraction operations shall be completed, material stockpiles removed, and processing equipment moved from the site by or before December 31, 2043. No time extensions to allow for any type of activity related to mineral extraction operations or material stockpiling or sales shall be granted. Although it is desired that all reclamation measures also be completed by the December 31, 2043, date, if not fully implemented by said date, the completion of mining company required reclamation measures shall continue as necessary. If reclamation is not completed by December 31, 2043, a detailed schedule for implementation of reclamation measures shall be provided to the City. All quarrying rights of the mining companies to extract minerals from the site shall terminate on December 31, 2043.
B. Reclamation Plan: Attached as exhibit B is the reclamation plan that shall be implemented unless otherwise amended per agreement between the quarries and the City of West Des Moines. This reclamation plan illustrates the intended postmining land use and shall be used to guide mining activities to achieve the identified plan elements. Ongoing reclamation progress in accordance with this plan shall be evaluated approximately every five (5) years. (Ord. 1851, 11-30-2009)
C. Adjustments: It shall be recognized that adjustments to the site plan and/or reclamation plan to accommodate alternative mining methods, unforeseen deposit/extraction issues, market demands, South Grand Prairie Parkway road construction timing and methods, and/or changes to desired postmining elements and locations shall be as agreed upon between the quarries and the City of West Des Moines. Prior to implementation of any changes, the need for a formal plan submittal to illustrate changes shall be as determined by the Director of Development Services. If said changes are determined to be substantial, the applicant shall submit, as determined by the Director of Development Services, either a minor or major modification to a site plan application to the City for review and approval by the appropriate approval body. Said application for modification shall provide that information necessary to evaluate the changes, but in general shall not be required to contain more information or detail than the original site plan. City approval is only intended to ensure that the proposed changes do not affect intended postmining activities; plan review shall not be for the purposes of directing extraction activities other than assuring compliance with applicable Code regulations and requirements.
