The developer of the Taco John's PUD and the city of West Des Moines have entered into a development agreement for vacation of such right of way as is necessary for the development of the Taco John's PUD and is shown on the vacation plat for such purpose. The development agreement also allows for the use of a portion of the remaining Fourth Street right of way for use in the Taco John's PUD. Such use shall be per the terms of the development agreement and such vacation and conveyance shall be per the triggering events in the development agreement.
The developer of the Taco John's PUD shall be required to execute and record a lot tie agreement to tie together the right of way conveyed to the rest of the development parcel. (Ord. 1879, 8-9-2010)
