The City Council of the City of West Des Moines hereby gives conditional approval to the revised Iowa Realty Community Unit Plan Proposal, The Knolls, generally located west of 50th Street, south of Ashworth Road, north of the Chicago and Northwestern Railroad, and east of Interstate 35. Approval is subject to the following conditions:
A. The written communication presented to the City by the Iowa Realty Co., Inc., dated December 5, 1974, and read into the minutes of the January 13, 1975 Council meeting is hereby acknowledged by the City and made an integral part of the plan submitted by Iowa Realty Co., Inc., and the conditions and requirements set forth in the said written communication shall be conditions under which the proposed community unit plan is accepted unless otherwise modified and amended by the City.
B. Conditioned upon acceptance given and granted by the City Council and/or reviewed and accepted by any other governmental entity or body with regard to:
1. All necessary trunk utilities and systems including, but not limited to, sanitary sewer, storm sewer, and water within and surrounding the proposed site and any extension for the same from their present existing locations to the site including any looping needed or required in the water system.
2. All drainage plans and structures.
3. All street plans and improvements, rights-of-way needed or required, dedications or easements, and method of funding or financing existing streets of the City adjacent to or contiguous to the proposal.
4. Plans for public park property and the dedication thereof including a timetable for the same.
5. Formulating any deed restrictions, easements (public and private), buffers, dedications for public purposes, and street improvements as it relates to each parcel.
C. All parcels other than those platted as single-family lots (proposed Parcels 6, 7, and 9) are accepted as being developed as PUDs in accordance with existing CUP or PUD guidelines. Accordingly, the following maximum unit numbers are set forth for each parcel:

D. Parcels 6 and 7 are accepted to be developed by R-1-A standards of the City of West Des Moines.
E. Parcel 9 is accepted as modified R-1 to meet all normal R-1 standards of platting with the following changes as proposed by Iowa Realty:
1. Minimum frontage shall be seventy feet (70') with an additional twenty feet (20') added to side yards on corner lots.
2. The minimum square footage of each lot shall be eight thousand five hundred (8,500) square feet.
F. Iowa Realty by submittal of this CUP binds itself and its successors and assigns to compliance with the CUP/PUD resolution passed by the City of West Des Moines on April 2, 1973.
G. This approval constitutes conditional acceptance of sheet #2 as presented by the Iowa Realty Co., Inc., with the changes in Parcel 4 from high rise to single-family attached, and Parcel 2 from single-family attached to medium density apartment type units. Both parcels shall be bound by the aforesaid maximum number of units set forth in subsection C of this Resolution.
H. Sheets 1, 3, 4 and 5, as presented, are accepted only as supporting documents intended to convey the intent of the developer in this proposal subject to further consideration by the City. (Resolution dated 1-20-1975)
