A. Public arts funds shall be appropriated and expended by the city council with the advice of the commission. The public arts program guidelines and principles are hereby adopted to provide guidance in the appropriation and expenditures of the public arts fund and in accordance with this chapter. These guidelines and principles may be amended only after a public hearing by the commission and adoption of a resolution by the city council.
B. The commission shall function in accordance with the adopted public arts program guidelines and policies and the ordinance establishing the commission.
C. Once a project has been included in the approved public arts work plan, the commission shall be responsible for the selection of artists, the commissioning of artworks, and the purchase of artworks. Projects recommended by the commission shall be presented to the city council for review and approval at the mock up or maquette stage, prior to the fabrication and installation of the artworks. All contracts or purchases shall be in accordance with the city's purchasing policies. Over time, the commission should aim to achieve an appropriate balance among local, regional, and national artists in the public arts program. The enduring quality of the artworks should be a primary consideration during artist selection.
D. The commission shall require that all artworks needing operations or maintenance be reviewed by the appropriate city department staff prior to the acquisition of that artwork. At least once every five (5) years, the commission shall be responsible for conducting a maintenance survey of the public arts collection. This survey shall include a condition report on each artwork, prioritized recommendations for the restoration, repair, or maintenance of artworks, and estimated costs. It shall be the responsibility of the various city departments to provide for the routine maintenance of artworks under their jurisdiction. Such routine maintenance shall be in accordance with approved plans submitted by each project artist. The commission shall monitor any nonroutine maintenance.
E. The commission may encourage and help obtain additional grants and gifts of public arts from outside sources.
F. Day to day management of the public arts program shall be provided by the city's parks and recreation department staff. (Ord. 1903, 1-24-2011)
