A. Each year, the city council shall budget discretionary funds from the hotel/motel fund to be appropriated and expended for acquisition or commissioning of artworks in accordance with the provisions of this chapter. Appropriations for purposes of acquiring artworks in order to carry out the provisions of this chapter shall be made in accordance with law and the budgeting procedures of the city. Development and placement of artworks shall be approved by the city council.
B. Appropriations and expenditures for artworks may include, but are not limited to, the costs and expenses incurred in the process of designing, fabricating, installing, and maintaining artworks in public buildings or grounds.
C. Any monies collected or designated in accordance with this chapter shall be deposited into the public arts fund by the finance director. The finance director shall establish accounting records sufficient to identify and control these funds. The account containing these funds shall earn interest and the earned interest shall be deposited in the city's general fund according to the code of Iowa. The public arts fund shall be authorized to accept gifts, grants, and donations made to the city for artworks. The public arts fund shall be self-perpetuating from year to year. Subfunds will be established as the finance director deems necessary to maintain compliance with public and private requirements.
D. Funds authorized or appropriated pursuant to this chapter may be expended for artworks in association with any current city projects or in existing public facilities and spaces which are owned by the city, if legally permissible.
E. In the case of any eligible construction project which involves the use of grant funds, or the proceeds of any bonds issued, amounts for artworks shall be used for projects and purposes consistent with state and federal laws, and the resolutions or policies approved by the voters or the city council, as applicable.
F. Unless any monies collected for the public arts fund are designated for a specific purpose or project, the monies shall be pooled into this fund.
G. An amount equal to fifteen percent (15%) of the public arts allocation for each project shall be set aside in a separate account to be used for the public arts program administration and community participation activities, including artist selection, design/proposal/maquette costs, consultant fees, project documentation, publicity, community education activities, interpretive plaques, and other purposes as may be deemed appropriate by the commission for the administration of the program. Funds in the program administration account not expended at the close of any fiscal year shall be carried forward into the next fiscal year.
H. An amount equal to ten percent (10%) of the public arts allocation for each project shall be set aside in a separate account for curatorial services and the preservation and maintenance of artworks in the public art collection. Funds in the maintenance and conservation account not expended at the close of any fiscal year shall be carried forward into the next fiscal year.
I. The public arts fund shall be used to provide sites for artworks in public places, but shall not be used for the purchase of any easement. Public artworks may be placed on public display, integral or attached to a public building or structure, detached within or outside a public building or structure, within or as a part of the landscape of a public park, square, or other outdoor public site or lands, part of a portable exhibition or collection, part of a temporary exhibition, or loaned or exhibited in other public facilities.
