The following definitions shall apply to this chapter and any policies, guidelines, and procedures that may be developed to implement the public arts program plan:
ARTIST: Any practitioner in the visual and design arts, generally recognized by critics and peers as a professional in the field as evidenced by his or her education, experience, exhibition record, and artwork production.
ARTWORKS: Works in a variety of media produced by professional artists; works may be permanent, temporary, or functional, and may be stand alone or integrated into the architecture or landscaping, if such are designed by an "artist" as defined herein, and should encompass the broadest range of expression, media, and materials. The term "artworks", does not include ineligible expenditures as described in section 7-15-4 of this chapter.
"Artworks" include:
A. "Sculpture": Sculptures may be made of any material or combination of materials; they may be freestanding, wall supported, or suspended, kinetic, electronic, or mechanical.
B. "Murals" Or "Paintings": Murals or paintings may be made of any materials or combination of materials with or without collage; they may be made by traditional or nontraditional means.
C. "Other": Earthworks, neon, glass, organic materials (fiber, clay, wood, etc.), mosaics, photographs, prints, literary expression, calligraphy, any combination of forms of media, including audio, video, film, CD-ROM, DVD, holographic, or computer generated technologies or new genres.
"Artworks" as defined herein may be permanent, fixed, temporary, or portable, they may be an integral part of a building, facility, or structure, and may be integrated with the work of other design professionals.
CAPITAL IMPROVEMENT PROGRAM (CIP): The city's program for capital development.
COMMISSION: The city's public arts advisory commission that advises the city council on expenditures from the public arts fund.
ELIGIBLE CONSTRUCTION PROJECT: Any permanent public improvement project paid for wholly or in part by the city, for the construction or renovation of any building, park, highway, road or street, streetscape or road beautification, bridge, transit or aviation facility, trail or bikeway, decorative or commemorative structure, viaduct or pedestrian overpass/underpass, parking facility, abovegrade utility, or any portion thereof, to which the public has access or which is visible from a public right of way.
ELIGIBLE PROJECT COSTS: The total project appropriation, less real property acquisition, demolition, environmental remediation, legal and accounting fees, and interest charges. It shall also exclude funding from any outside source, if such funds are not permitted to be used for artworks.
PUBLIC ARTS COLLECTION: The artworks owned by the city, regardless of whether they were accumulated before or after the effective date of this chapter.
PUBLIC ARTS FUND (FUND): A separate account into which all monies generated under this chapter or derived from gifts or donations for public arts shall be deposited.
PUBLIC PLACE: An area on public or private property that is legally accessible and visible to the general public.
RENOVATION: Any major redesign of a facility or system or portion thereof which is included in eligible construction projects, including expanding or upgrading the capacity of the facility or system, or enlarging the facility or creating a new use for the facility. It does not include repairs, maintenance, or installation of replacement mechanical equipment or modifications required solely for the purposes of code compliance. (Ord. 1903, 1-24-2011)
