Any person aggrieved by any decision made by the ADA Coordinator regarding the access or alleged discrimination to public facilities or services and programs may appeal to the Mayor and City Council. The appeal shall be completed by filing with the City Clerk within ten (10) days from the date of the written decision by the ADA Coordinator, a notice of appeal requesting a hearing of the appeal setting forth the complaint of discrimination.
Failure to file a timely written petition as required herein shall constitute a waiver of the right to appeal and the decision of the ADA Coordinator shall constitute a final determination.
Upon receipt of a timely filed written petition with the Mayor and City Council, the City Clerk shall place the appeal on the next regular City Council agenda. Written notification of the time, place and nature of the hearing shall be given to the petitioner within five (5) working days after the written petition is filed with the City Clerk.
The hearing shall be scheduled no later than twenty (20) working days after the date on which the written petition was filed and may be extended for a reasonable period by the Mayor, at his or her discretion, or upon written request from the petitioner or the ADA Coordinator, for good cause shown. A hearing notice shall be placed with a wide range of media. Request will be made that notice shall appear in at least one of each of the following as is available in the media market: newspaper, radio and closed caption television. Upon written notification of the petitioner or any interested citizen, the City Clerk will provide information in Braille or on audiocassettes for vision impaired. Further, a sign language interpreter for the hearing impaired will be available at the hearing, upon written notice made to the City Clerk seven (7) working days in advance of the hearing.
Due to the failure of a petitioner to appear at a scheduled hearing of an appeal, the Mayor and City Council may proceed with the hearing and make a decision in the absence of the petitioner. (Ord. 1293, 3-23-1998)
