10-1-12: LIQUOR CONSUMPTION IN PUBLIC PLACES:
   (A)   It shall be unlawful for any person to consume or cause to be consumed any beer or intoxicating liquor in any public place or building or at any public gathering, within the limits of the city. Provided, however, that this shall not apply to premises which hold a current and valid license to dispense beer or intoxicating liquor or an event granted a catering permit, which may be issued by the city pursuant to Idaho Code section 23-934A for consumption of alcoholic beverages at the city park. A catering permit will only be granted in conjunction with the granting of a completed special event application as may be required by the City Council which shall be attached to a catering permit application. A catering permit requires City Council approval, fourteen (14) days prior to the event. "Public place", as defined in this section, includes any place, building or conveyance, to which the public has or is permitted to have access, and any place, highway, street, lane, park or place of public resort or amusement, within the limits of the city.
   (B)   Any person violating any of the provisions of this section shall, upon conviction thereof, be fined in any sum not less than twenty five dollars ($25.00) nor more than three hundred dollars ($300.00), or imprisonment in the city jail for a period not to exceed thirty (30) days, or by both such fine and imprisonment.
