9-2-2: REMODELING, ALTERATION OF BUILDINGS IN FIRE LIMITS:
No wooden or other building or structure not conforming to the requirements of the building code of the city and already within the fire limits of the city shall be remodeled, enlarged, altered, repaired, constructed or reconstructed with combustible materials in such manner as to increase its height, size or dimensions; provided, that ordinary deterioration and wear may be repaired, and also that the building inspector may grant permission to lathe and plaster, insulate or repair wooden and nonconforming buildings or structures with noncombustible materials. If any wooden or nonconforming building or structure within the fire limits suffers damage by fire, wind or other similar elements to the extent of fifty percent (50%) of the then value of such building or structure, then the same may not be repaired, rebuilt or reconstructed with any type of material or under any circumstances, and the owner of such damaged building or structure shall remove such remnants and debris, and the owner of such property will be liable to the city for the reasonable costs of such removal, and the city may file a lien against the land upon which said building or structure was located.
