122.06 BOND REQUIRED.

Before a license under this chapter is issued, each applicant shall post a bond with the City Clerk in an amount established by resolution of the Council. Such bond shall be conditioned to indemnify and pay the City for any penalties or costs occasioned by the enforcement of this chapter, and shall not be released or rescinded until after a lapse of 30 days from the expiration of each license or the completion of any pending prosecutions of violations against the applicants and payment of all fines and costs associated therewith.

122.07 LICENSE ISSUED.

The City Clerk, upon review of said license application and in consultation with the Police Chief, shall issue a license to the applicant if the information in the application is found to be correct, if the required fees and bond are paid, and if the applicant has not been convicted of an offense involving sexual abuse and/or a crime requiring sex offender registration, serious injury or death to another person, kidnapping, false imprisonment, robbery, burglary, theft, fraud, forgery, identity theft, trespass, harassment, or stalking.

122.08 DISPLAY OF LICENSE.

Each solicitor or peddler shall at all times while doing business in the City keep in their possession the license provided for in Section 122.07 of this chapter, and shall, upon the request of prospective customers, exhibit the license as evidence of compliance with all requirements of this chapter.

122.09 LICENSE NOT TRANSFERABLE.

Licenses issued under the provisions of this chapter are not transferable in any situation and are to be applicable only to the person filing the application.

122.10 TIME RESTRICTION.

All licenses shall provide that said licenses are in force and effect only between the hours of 9:00 a.m. and 6:00 p.m., Monday through Saturday.

122.11 REVOCATION OF LICENSE.

The City Clerk may revoke any license issued under this chapter if the licensee, in the application for the license or in the course of conducting their business has made incorrect or fraudulent statements, or has conducted their business in an unlawful manner, or violated an ordinance or statute, or if the licensee has conducted their business in such a manner as to endanger the public welfare or safety.

122.12 RIGHT TO APPEAL REVOCATION.

The licensee may appeal the revocation of the license to the City Council at its next regularly scheduled meeting by filing with the City Clerk a written request for an appeal to the City Council. The City Council may affirm, modify, or reverse its decision or the decision of the City Clerk to revoke such license.

122.13 REFUNDS ON LICENSES.

Any licensee who surrenders their license or has their license revoked prior to the date of expiration shall not be entitled to a refund of any portion of the application or license fees.
