A. Posting: The license certificate or temporary permit issued pursuant to this chapter shall be conspicuously posted in the office of or on the premises of the mobile home park at all times.
B. Renewal Of License: Upon application in writing by a licensee for renewal of a license issued pursuant to this chapter, and upon payment of the annual license fee, the health officer shall issue a certificate renewing the license for another year if mobile home park has been operated satisfactorily and the standards of this chapter have been maintained.
C. Transfer Of License: Upon application in writing for the transfer of a license issued pursuant to this chapter and payment of the transfer fee, the health officer shall transfer the license if the transferee is of good moral character, if the mobile home park has been operated satisfactorily, and the standards of this chapter have been maintained.
D. Scope, Term Of Permit:
1. A permit, upon written request therefor, may be issued by the health officer for every mobile home park in existence on March 18, 1968, permitting the park to be maintained and operated during the period ending one year after March 18, 1968, without being subject to certain provisions of this chapter, which provisions are hereinafter expressly stated to be inapplicable to existing mobile home parks.
2. The term of a permit issued pursuant to this chapter may be extended, upon written request, for not to exceed one additional period of one year, if:
a. The permittee shall have filed application for a license in conformity with this chapter within ninety (90) days after March 18, 1968.
b. The permittee is of good moral character, and the park plans and specifications accompanying the application for the license comply with all provisions of this chapter and all other applicable provisions of this code and other city ordinances and statutes.
c. The permittee shall have diligently endeavored to make the existing park conform fully to the plans and specifications submitted with the application.
d. Failure to make the existing park conform fully to such plans and specifications shall have been due to causes beyond the control of the permittee.
E. Restrictions On Operation Without Permit:
1. A mobile home park that is in existence on March 18, 1968, but does not meet the minimum requirements of this chapter, shall be allowed to continue its operation as a nonconforming use, but cannot expand, remodel or change its mode of operation without updating the mobile home park to the requirements of this chapter.
2. All provisions and conditions of this chapter are applicable to nonconforming parks except subsections 9-10-9B2, B4, B7 and B10 of this chapter. (Ord. 2449, 3-18-1968)
The health officer may revoke any license issued pursuant to sections 9-10-5, 9-10-6 and 9-10-7 of this chapter when the licensee has been found guilty by a court of competent jurisdiction of violating any provision of this chapter. After such conviction, the license shall be reissued if the circumstances leading to conviction have been remedied and the park is being maintained and operated in full compliance with law. A. Location; Fences: A mobile home park may be located in any district as provided by the zoning ordinance. Where any boundary of a park directly abuts property which is improved with a permanent residential building located within twenty five feet (25') of the boundary or directly abuts unimproved property which may under existing laws and regulations be used for permanent residential construction, a fence, wall or hedge shall be provided along such boundary.
B. Park Plan; Design Requirements: The mobile home park shall conform to the following requirements:
1. The park shall be located on a well drained site, properly graded to ensure rapid drainage and free from stagnant pools of water with an adequate storm sewer and connected to nearest storm sewer facilities available that will handle the flow.
2. Each mobile home park shall provide individual mobile home spaces and each such space shall be clearly defined or delineated. Each individual space shall have an area not less than the minimum area requirements of the zoned district in which the park is located, but in no case shall the area requirements for each individual space be less than three thousand (3,000) square feet per space, and a width of not less than thirty feet (30').
3. Each mobile home space shall be provided with a paved patio of at least eighty (80) square feet.
4. Mobile homes shall be so located on each space that there shall be at least a twenty foot (20') clearance between mobile homes; however, with respect to mobile homes parked end-to-end, the end-to-end clearance may be less than twenty feet (20') but not less than fifteen feet (15'). In determining the clearance requirements, an annex shall be considered an integral part of the mobile home; however, where the annex is less than half of the length of the mobile home to which it is attached, the clearance may be less than twenty feet (20'), but not less than fifteen feet (15'). No mobile home shall be located closer than fifteen feet (15') from any building within the mobile home park or from any property line bounding the mobile home park.
5. All mobile home spaces shall have access to a roadway of not less than eighteen feet (18') in width, which shall have unobstructed access to a public street, alley or highway and the sole vehicular access shall not be by an alley, and all dead-end roadways shall include adequate vehicular space or cul-de-sac.
6. Walkways not less than two feet (2') wide shall be provided from the mobile home spaces to the roadways.
7. Walkways and roadways shall be all-weather surfaced, using a type of construction approved by the city engineer. These walkways and roadways shall be properly maintained and shall be lighted at night with electric lamps of not less than sixty (60) watts each, spaced at intervals of not more than one hundred feet (100'), or equivalent illumination as may be supplied by other approved sources.
8. An electrical outlet supplying at least two hundred twenty (220) volts shall be provided for each mobile home space with a minimum one hundred (100) ampere individual service.
9. Each park shall provide service buildings to house such toilet, bathing and other sanitation facilities as are prescribed in this section.
10. Each park shall provide one off-street automobile parking space, with a minimum of one hundred eighty (180) square feet, for each mobile home space, which may be included within the square foot requirements of the lot.
C. Water Supply: An adequate supply of pure water for drinking and domestic purposes shall be supplied by pipes to all buildings and mobile home spaces within the park, to meet the requirements of the park. Each mobile home space shall be provided with a cold water tap of three-fourths inch (3/4") pipe above the ground. An adequate supply of hot water shall be provided at all times in the service buildings for all bathing, washing and cleansing facilities.
D. Sanitation Facilities For Dependent Mobile Homes:
1. Each mobile home park which accommodates dependent mobile homes shall be provided with the following sanitation facilities:
a. One flush toilet and one urinal for males; one flush toilet for females; one lavatory for each sex; and one shower or bathtub with individual dressing accommodations for each sex, for the first ten (10) mobile homes of such type or any lesser number thereof so accommodated.
b. One additional flush toilet and one additional urinal for males; one additional flush toilet for females; one additional lavatory for each sex; and one additional shower or bathtub with individual dressing accommodations for each sex, for each ten (10) mobile homes of such type or fractional number thereof in excess of ten (10) mobile homes of such type so accommodated.
2. Each toilet and each shower or bathtub with individual dressing accommodations, for which provision is made in subsection D1 of this section shall be in a private compartment or stall.
3. The toilet and other sanitation facilities for males and females shall be either in separate buildings or shall be separated, if in the same building, by a soundproof wall. The sanitation facilities for males and females shall be distinctly marked to denote the sex for which they are intended.
E. Service Buildings:
1. Service buildings housing sanitation facilities shall be permanent structures complying with all applicable statutes, provisions of this code and other city ordinances regulating buildings, electrical installations and plumbing and sanitation systems.
2. The service buildings shall be well lighted at all times of the day and night; shall be well ventilated with screened openings; shall be constructed of such moisture-proof material, which may be painted woodwork, as shall permit repeated cleaning and washing; and shall be maintained at a temperature of at least sixty eight degrees Fahrenheit (68°F) during the period from the October 1 to May 1. The floors of the service buildings shall be of water-impervious material.
3. All service buildings and the grounds of the park shall be maintained in a clean, sightly condition and kept free of any condition that will menace the health of any occupant or the public or constitute a nuisance.
F. Sewage Disposal:
1. Waste from showers, bathtubs, flush toilets, urinals, lavatories and slop sinks in service and other buildings within the mobile home park shall be discharged into the public sewer system in compliance with applicable provisions of this code and other city ordinances.
2. Each mobile home space shall be provided with a sewer at least four inches (4") in diameter, which shall be connected to receive the waste from the shower, bathtub, flush toilet, lavatory and kitchen sink of the mobile home harbored in the space and having any or all of such facilities. The sewer in each space shall be connected to discharge the home waste into the public sewer system in compliance with applicable provisions of this code and other city ordinances.
G. Garbage Receptacles And Disposal: Metal garbage cans with tight-fitting covers shall be provided in quantities adequate to permit disposal of all garbage and rubbish. Garbage cans shall be located not farther than three hundred feet (300') from any mobile home space. The cans shall be kept in sanitary condition at all times. Garbage and rubbish shall be collected and disposed of as frequently as may be necessary to ensure that the garbage cans shall not overflow.
H. Fire Prevention; Natural And Liquefied Petroleum Gas:
1. Standard fire hydrants shall be located within three hundred feet (300') of each mobile home.
2. Natural and liquefied petroleum products may be used at individual mobile home spaces, provided that the installations comply with the city gas piping code.
3. No open fires shall be permitted at any place which may endanger life or property. No fires shall be left unattended at any time. (Ord. 2449, 3-18-1968)
