   1305.06 SUSPENSION OR REVOCATION; APPEALS.
   (a)   Any contractor's registration may be suspended or revoked by the Building Official if the holder of the registration willfully, or by reason of reckless disregard, violates any statute of the State, or an ordinance, rule or regulation of the City, or the Building Code, relating to the erection, construction, repair, improvement, replacement, removal, alteration or remodeling of any building within the City, done for hire for another. Further, any registration may be suspended or revoked upon conviction of the holder of any criminal charge relating to trustworthiness or breach of fiduciary duty.
   (b)   Any aggrieved person may appeal this decision in accordance with Chapter 1311 .

   1305.07 ASSIGNMENT AND TRANSFER.
   No registration issued in accordance with the provisions of this chapter shall be assignable or transferable.

   1305.08 WAIVER OF LIABILITY.
   Any homeowner of a single family dwelling occupied by that homeowner can exempt himself or herself from the requirements of Section 1305.015 as to that dwelling by filing a waiver of liability on the prescribed form provided by the appropriate Building Division Inspector.
   Any person desiring to improve a vacant dwelling, who will be a primary occupant of the dwelling upon completion of the improvements, can exempt himself or herself from the requirements of Section 1305.015 as to that dwelling by filing a waiver of liability and agreeing to reside in the dwelling for a period of two years from the date of occupancy. The waiver and agreement shall be on the form provided by the appropriate Building Division Inspector.

   1305.09 LIABILITY.
   This chapter shall not be construed as imposing on the City any liability or responsibility for damages resulting from any defective construction work or equipment or installation thereof, nor shall the City or any official or employee thereof be held to assume any liability or responsibility by reason of any act or action taken in enforcing the provisions of this chapter or carrying out the duties authorized and required by this chapter.

   1305.10 PERMITS; APPLICATION AND ADMINISTRATION.
   The application and issuance of any permit provided for within this chapter shall be in accordance with Chapter 1307 .

   1305.11 FAILURE TO OBTAIN A CONTRACTOR’S REGISTRATION.
   If any work is commenced by a person, firm, company or corporation engaged in the business of contracting for services to be rendered, in part or in full, as described in Section 1305.015 , whether residential or commercial, before obtaining the necessary and appropriate contractor registration from the Engineering, Planning and Building Department, the appropriate registration fee set out in this chapter shall be increased to two (2) times the applicable amount and payable before said work can continue. The payment of such adjusted registration fee shall not relieve any person, firm or corporation from fully complying with all the requirements of the City of Warren Building Code, nor shall such payment exempt the person, firm or corporation from any other penalty provided for by the Codified Ordinances of the City.

   1305.12 EXEMPTIONS.
   Public utility companies, and their subcontractors, are exempt from the provisions of this Chapter 1305 .
