   1305.04 ISSUANCE OF REGISTRATION; EFFECTIVE DATE.
   A contractor's registration may be issued to any person who has complied with this chapter and who otherwise has complied with any applicable federal or state licensing requirements. However, a registration need not be issued if it is established to the satisfaction of the Building Official that the applicant has been guilty of facts, things or practices for which a registration may be suspended or revoked pursuant to Section 1305.06 .
   The registration required herein shall become effective on April 1, 1994 and shall be renewed in accordance with Section 1305.05 .

   1305.05 REGISTRATION RENEWAL.
   Each contractor registration shall be approved once the Law Department approves the surety bond. The surety bond will only be sent to the Law Department for approval once all other requirements are on file in accordance with Section 1305.02 (c). The date the Law Department approves the surety bond will be the date the contractor registration becomes effective. The contractor registration shall expire one (1) calendar year from the date of the Law Department’s approval of the surety bond.
   A continuation certificate provided by the insurance company, as approved by the Law Department, shall be an acceptable form of extending the initial surety bond from year to year after the initial registration.
   The City may properly refuse to renew any registration if cause for suspension or revocation of the registration as described in Section 1305.06 has been shown to exist.

   1305.06 SUSPENSION OR REVOCATION; APPEALS.
   (a)   Any contractor's registration may be suspended or revoked by the Building Official if the holder of the registration willfully, or by reason of reckless disregard, violates any statute of the State, or an ordinance, rule or regulation of the City, or the Building Code, relating to the erection, construction, repair, improvement, replacement, removal, alteration or remodeling of any building within the City, done for hire for another. Further, any registration may be suspended or revoked upon conviction of the holder of any criminal charge relating to trustworthiness or breach of fiduciary duty.
   (b)   Any aggrieved person may appeal this decision in accordance with Chapter 1311 .

   1305.07 ASSIGNMENT AND TRANSFER.
   No registration issued in accordance with the provisions of this chapter shall be assignable or transferable.

   1305.08 WAIVER OF LIABILITY.
   Any homeowner of a single family dwelling occupied by that homeowner can exempt himself or herself from the requirements of Section 1305.015 as to that dwelling by filing a waiver of liability on the prescribed form provided by the appropriate Building Division Inspector.
   Any person desiring to improve a vacant dwelling, who will be a primary occupant of the dwelling upon completion of the improvements, can exempt himself or herself from the requirements of Section 1305.015 as to that dwelling by filing a waiver of liability and agreeing to reside in the dwelling for a period of two years from the date of occupancy. The waiver and agreement shall be on the form provided by the appropriate Building Division Inspector.

   1305.09 LIABILITY.
   This chapter shall not be construed as imposing on the City any liability or responsibility for damages resulting from any defective construction work or equipment or installation thereof, nor shall the City or any official or employee thereof be held to assume any liability or responsibility by reason of any act or action taken in enforcing the provisions of this chapter or carrying out the duties authorized and required by this chapter.

   1305.10 PERMITS; APPLICATION AND ADMINISTRATION.
   The application and issuance of any permit provided for within this chapter shall be in accordance with Chapter 1307 .
