As used in this chapter:
(a) “General contractor” means any person, firm, company or corporation engaged in the business of contracting for services to be rendered, in part or in full, for any work in connection with the location, erection, construction, repair, alteration, moving and/or equipping of a building or structure which is subject to the OBC or the Residential Code of Ohio for One-, Two- and Three-Family Dwellings (as in effect on May 27, 2006) and all subsequent revisions, additions and appendices thereto, and all work defined as a “street contract”.

(b) “Mechanical contractor” means any person, firm, company or corporation engaged in the electrical, plumbing, heating or air conditioning business contracting for services to be rendered, in part or in full, for any work which requires a license from the State of Ohio, Ohio Construction Examining Board and all work defined as a “street contractor”.
(c) “Street contractor” means any person, firm, company or corporation engaged in the business of contracting for services to be rendered, in part or in full, for any work in connection with the location, erection, construction, repair, alteration, or moving of curb, pavement, sidewalk, driveway, driveway and ditch pipes, sanitary and storms ewers, or any other type of construction, except for gas and water lines, within the street right of ways and public places of the City. Gas and water lines can only be constructed, repaired, altered or moved by a “mechanical contractor”.

No person, firm, company or corporation shall engage in the business of contracting for services to be rendered, as defined in Section 1305.01, in part or in full, for any work in connection with the location, erection, construction, repair, alteration, moving and/or equipping of a building or structure which is subject to the Ohio Building Code (OBC) or the Residential Code of Ohio for One-, Two- and Three-Family Dwellings (as in effect on May 27, 2006) and all subsequent revisions, additions and appendices thereto, without first registering with the City.

Further, no person, firm, company or corporation shall engage in the business of contracting for services to be rendered, as defined in Section 1305.01
of this chapter, in part or in full, for any work in connection with the location, erection, construction, repair, alteration or moving of sidewalks, driveways, driveway and ditch pipes, waterlines, sanitary and storm sewers, or any other type of construction within the street rights of way and public places of the City without first registering with the City.
The registration requirements of this section are not intended to, and shall not, replace or supersede any applicable federal or state licensing requirements.
A fee of $50.00 shall be charged in addition to the fees for contractor registrations as described elsewhere in this chapter for all improperly submitted or incomplete documents, as required to be submitted for a contractors registration pursuant to Section 1305.02
(c) of this chapter, for each and every submittal that must be returned to the applicant, by the City, for additional information, signatures, forms, etc. that are required for approval by the City.
This section also does not apply to such work done, or caused to be done, by the United States of America or the State of Ohio.

(a) Application for registration shall be made in writing to the Building Official on a prescribed form. Each application from an individual shall include the individual's full name, address, social security number and business address.
(b) Each application from a partnership, corporation or other business entity shall include the name and address of the business, as well as the names, addresses and social security numbers of the principals of the business.
(c) Each applicant shall also provide the following information or documentation to accompany the application as follows:
(1) A current City of Warren, Ohio Income Tax account number; and
(2) Other than self proprietorship, proof of a current Ohio Worker's Compensation certificate; and
(3) A current Federal Tax Identification Number; and

(4) A surety bond to the City in the sum of ten thousand dollars ($10,000) with sureties thereon, conditioned upon the faithful performance by the contractor of all the work entered into or contracted for by such contractor, and upon the strict compliance of the contractor with all the provisions and requirements of the ordinances of the City relating to the work performed under the registration, and indemnifying the City against any and all losses and damages by reason of any negligence on the part of the contractor or contractor's agents or employees including subcontractors while engaged in the prosecution of any business as such contractor. Such bond must be kept current during the effective life of the registration. The bond shall be renewed annually, along with the registration. However, only one surety bond will be required of a person, firm or corporation regardless of the amount of contracting business or building trades a registration is applied for. Failure to maintain such bond is grounds for suspension or revocation, as set forth in Section 1305.06

(5) Proof of a current comprehensive general liability insurance coverage, with a minimum limit of three hundred thousand dollars ($300,000) each occurrence combined single limit for bodily injury and property damage liability. Such coverage shall be kept current during the effective life of the registration. The policy shall be renewed annually, along with the registration. Failure to maintain such coverage is grounds for suspension or revocation of a registration, as set forth in Section 1305.06

(6) Proof of compliance with state or federal licensing requirements, if applicable, particularly Ohio R.C. Chapter 4740 which requires heating, ventilating and air conditioning, refrigeration, electrical, plumbing and hydronics contractors to be certified by the State; and

(7) Any such other information and documentation as the City may, from time to time, require or request.

Before a contractor’s registration is granted to any applicant and before any expiring registration is renewed, the applicant shall pay to the City the following fees:

Any existing contractor license or registration in effect prior to the effective date of this section shall remain in effect until it expires. Upon expiration, if the contractor renews the license or registration within six (6) months from the expiration date, the applicable renewal fee described in this section will apply. If more than six (6) months lapses from the expiration date, the initial fee shall apply.

A contractor's registration may be issued to any person who has complied with this chapter and who otherwise has complied with any applicable federal or state licensing requirements. However, a registration need not be issued if it is established to the satisfaction of the Building Official that the applicant has been guilty of facts, things or practices for which a registration may be suspended or revoked pursuant to Section 1305.06

The registration required herein shall become effective on April 1, 1994 and shall be renewed in accordance with Section 1305.05

Each contractor registration shall be approved once the Law Department approves the surety bond. The surety bond will only be sent to the Law Department for approval once all other requirements are on file in accordance with Section 1305.02
(c). The date the Law Department approves the surety bond will be the date the contractor registration becomes effective. The contractor registration shall expire one (1) calendar year from the date of the Law Department’s approval of the surety bond.
A continuation certificate provided by the insurance company, as approved by the Law Department, shall be an acceptable form of extending the initial surety bond from year to year after the initial registration.
The City may properly refuse to renew any registration if cause for suspension or revocation of the registration as described in Section 1305.06
has been shown to exist.

(a) Any contractor's registration may be suspended or revoked by the Building Official if the holder of the registration willfully, or by reason of reckless disregard, violates any statute of the State, or an ordinance, rule or regulation of the City, or the Building Code, relating to the erection, construction, repair, improvement, replacement, removal, alteration or remodeling of any building within the City, done for hire for another. Further, any registration may be suspended or revoked upon conviction of the holder of any criminal charge relating to trustworthiness or breach of fiduciary duty.
(b) Any aggrieved person may appeal this decision in accordance with Chapter 1311
