723.02. License required.
   No person, society, club, firm, organization or corporation shall hold any public dance, teen dance, or give instruction in dancing for hire in any hall within the limits of the City until the dance hall in which the same may be held has first been duly licensed for such purposes. Provided, however, that such person or persons obtaining such licenses must enforce at such dance the requirements herein provided for the governing of public dance halls and, if teen dances are to be held on the premises, the additional requirements set forth in Section 723.15, below. Failure on the part of any person or persons to obtain such license or to comply with the foregoing shall subject him or them to the penalties provided for in this chapter.

723.03. Application for license.
   Every person, society, club, firm, organization or corporation desiring a license to operate a public dance hall and/or teen dance club must make personal application to the Director of Finance. Each application shall be in the form prescribed herein. Such application shall be filed at least ten days prior to the time of granting such license, and after an investigation as hereinafter provided, shall be transmitted to the Division of Treasury for issuance of a license.

723.04. Application Information.
   Every applicant for a dance hall license and/or teen dance club license shall file with the Director of Finance a written application stating the name and address, including street and number, of the applicant, or if more than one person or if an association or firm, the full name of all parties interested and the addresses including street and number. If the applicant is a club, firm, society, organization or corporation, the applicant shall contain a complete list of the officers of such club, society, organization, firm, or corporation, with their names and addresses, including street and number, and shall also give the state in which such club, society, organization, firm or corporation is organized and the names of one or more persons whom the club, society, firm, organization or corporation desires to designate as its manager or managers, or person or persons, in charge with their addresses. The application shall also state the following:
   (a)   The location where such dance, dance hall, teen dance, or teen dance club is to be conducted, including street and number.
   (b)   If the applicant is an individual, the name, address, social security number, and date of birth of the applicant. If the applicant is a club, society, firm, organization, corporation, or group of individuals, the names, addresses, social security numbers, and dates of birth of the officers, managers and/or members of said organization.
   (c)   Whether the applicant (or any person listed on the application) has ever been engaged in operating a dance hall or teen dance club, and when, where and how long in each place, within five years then last past.
   (d)   The name of the owner of the premises in which such dance hall or teen dance club is located and the complete address of such owner.
   (e)   Whether the location will be used for teen dances within the meaning of Section 723.15 below, and if so the names, addresses, social security numbers, dates of birth and signatures of each person who will be serving as a “Supervising Adult or Chaperon” as required by Section 723.15, below. If the owner of the premises rents the hall or club to an individual or organization who intends to use same for a teen dance, the owner of the premises shall notify the Vice and Narcotics Section of the Toledo Police Department of the fact of the rental and purpose of the event and designate an individual or, in the case of an organization, a manager or one of its principal officers who shall provide the information required of this section and listed above.
   (f)   The application shall be signed by the applicant or applicants, or in case of a club, society, firm, organization or corporation, the application shall be signed by the manager or one of its principal officers. Each person whose name is listed on the application for license or notification of designee in any capacity shall sign an authorization for a criminal record check.

723.05. Investigation of application.
   The Director of Finance shall require an investigation of each application for a license and shall determine whether or not the dance hall or event sought to be licensed complies with the regulations, ordinances and laws applicable thereto, and shall cause an investigation as to the character and fitness of the applicant or applicants, or the officers of the club, society, firm, organization or corporation (including each person listed on the application) and of the person, who is to have the general management of such dance hall, as well as an investigation of all persons listed as “Supervising Adults or Chaperons” for teen dances. This investigation is to be conducted by the Vice and Narcotics Section of the Toledo Police Department.

723.06. Compliance with health, building and fire regulations.
   No license for a public dance hall and/or teen dance club shall be issued until it is found that such hall complies with and conforms to all ordinances and to all health, building and fire regulations of the City; that it is property ventilated and supplied with sufficient toilet conveniences, and is a safe, sanitary and proper place for the purpose for which it is to be used. For the purposes of carrying out the provisions of this section, all applications for dance hall licenses shall be endorsed by the Commissioner of Health, the Commissioner of Inspection, and the Chief of the Fire Division, that such building complies with the rules of their several departments before a license shall be issued as provided herein.

723.07. Rejection of application.
   The application for a public dance hall and/or teen dance club license shall be rejected if the report submitted therewith shows that any of the persons named in the application (including Supervising Adults for teen dances) have previously been connected with public dance hall and/or teen dance club where the license has been revoked, or where the place sought to be licensed has been the source of disorderly or criminal conduct, or has substantially interfered with public peace or good order in the neighborhood, or where any of the provisions with reference to public dance halls and/or teen dance clubs have been violated, or if the place sought to be licensed as a dance hall does not comply in every way with the regulations, ordinances and laws applicable thereto. In addition, if it is determined that any person named in an application or any Adult Supervisor for teen dances has been convicted of a felony, drug or alcohol offense, or corruption of a minor or child endangering, the license shall be rejected.

723.08. Denial or revocation of license; appeals.
   (a)   Any applicant whose application for a public dance hall license and/or teen dance club license is denied by the Director of Finance shall be notified in writing of the denial by the Director. Such applicant may appeal the denial to a Board of Appeals comprised of the Director of Law, who shall act as Chair of the Board of Appeals, the Director of Public Safety and the Director of Public Service, or their selected representatives. A written request for an appeals hearing shall be submitted to the Director of Finance within ten days after receipt of the application denial notice.
   (b)   The Director of Finance, upon the recommendation of the Chief of Police, or as a result of his own investigation may revoke the public dance hall license and/or teen dance club license issued to any person, society, club, firm, organization or corporation under the provisions of this chapter, where the place so licensed has been the source of disorderly or criminal conduct, or has substantially interfered with public peace or good order in the neighborhood, or because any person named in an application has been convicted of a felony, drug or alcohol offense, or corruption of a minor or child endangering or for a violation of any provision of this chapter. Any person, society, club, firm, organization or corporation whose public dance hall license and/or teen dance club license has been revoked by the Director of Finance shall be notified in writing of the revocation by the Director of Finance. Such person may appeal the revocation to the Board of Appeals created in subsection (a) hereof. A written request for an appeal hearing shall be submitted to the Director of Finance within ten days after receipt of the license revocation notice.
   (c)   The Board of Appeals, so herein established, shall hear any appeal, pursuant to subsections (a) and (b) hereof within thirty days from the date the request for appeal is received by the Director of Finance. The Board shall have the power to sustain, modify or reverse the decision of the Director of Finance. The Board’s decision shall be in writing and sent to the appellant/applicant, or his/her legal representative, within fifteen days after the hearing is concluded. The action of the Board of Appeals is final.
