There is hereby adopted and incorporated by reference as if set out at length herein for the purpose of prescribing regulations governing conditions related to air pollution that certain code known as Ohio Administrative Code Chapter 3745-19 Open Burning Standards.

The Division of Pollution Control hereby adopts by reference Chapter 507 of the General Offenses Code, known as the Anti-Noise Law.

The City hereby adopts by reference in this Pollution Control Code, the water concepts, standards and criteria which have been or in the future will be adopted by the State. Such uses, standards and criteria shall be applicable to the waters of the City as defined in Chapter 3745-1 of the Ohio Administrative Code. All other waters of the City shall meet the stream water quality criteria for all uses except that storm sewer waters shall meet the criteria for the open waters of the City into which they flow.

(a) "Hazardous waste transfer facility" means any facility whose primary purpose is the loading, unloading, pumping or packaging of hazardous waste but does not include any facility that is required to obtain a hazardous waste facility installation and operation permit under Chapter 3734 of the Revised Code and rules adopted under that chapter.
(b) "Infectious waste treatment facility" means an infectious waste treatment facility for which a license is required under Section 3734(B) of the Revised Code and also includes a solid waste incineration facility for which the license issued under Section 3734.05(A)(1) includes the notation authorizing the treatment of infectious waste made pursuant to division (B)(3) of that section.
(c) "Petroleum contaminants" do not include any contaminant that is regulated as a hazardous waste under Chapter 3734 of the Revised Code and rules adopted under that chapter.
(d) "Soil remediation facility" means a facility that treats soil containing petroleum contaminants with heat to remove the contaminants.
(e) "Waste material" includes hazardous waste, infectious waste, material which contains hazardous waste or infectious waste or is derived from hazardous waste or infectious waste, or any other substance which poses a potential hazard to human health or safety or to the environment when improperly managed, but does not include solid waste, household waste, any mixture of domestic sewage and other waste that passes through a sewer system to a publicly owned treatment works, and wastewater treatment plant or water treatment plant sludges.
(f) "Waste material facility" means any hazardous waste transfer facility, soil remediation facility, or any other facility whose primary purpose is the treatment, storage, transfer, or disposal of waste material, but which is not subject to the hazardous waste facility installation and operation permit, byproduct disposal facility permit, or infectious waste treatment facility license required under Revised Code Chapter 3734.

(a) No person shall install, construct or operate a waste material facility within the City of Toledo without first obtaining the approval of the Division of Environmental Services. The application for approval shall contain:
(1) The activities conducted by the applicant which require the approval of the Division of Environmental Services;
(2) Name, mailing address, and location of the facility for which the application is submitted;
(3) The operator's name, address, telephone number and ownership status;
(4) A listing of all permits or approvals, state or federal, received or applied for, under any of the following programs:
A. Hazardous waste;
B. Underground injection control;
C. National pollutant discharge elimination system;
D. Prevention of significant deterioration (Clean Air Act);
E. Nonattainment (Clean Air Act);
F. National emission standards for hazardous pollutants;
G. Ocean dumping (Marine Protection Research and Sanctuaries Act);
H. Other relevant environmental permits.
(5) A topographic map (or other map if a topographic map is unavailable) extending one mile beyond the property boundaries of the facility or activity, depicting the facility and each of its intake and discharge structures, and those wells, springs, other surface water bodies and drinking water wells listed in public records or otherwise known to the applicant within one- quarter mile of the facility property boundary.
(6) A brief description of the nature of the business.
(7) A description of the process to be used for the treatment, storage, transfer or disposal of waste material and the design and capacity of each unit.
(8) An estimate of the quantity of waste material to be treated, stored, transferred or disposed of annually.
(b) The Division of Environmental Services shall not grant permission to install, construct or operate a waste material facility unless all siting criteria specified in Section 1777.07 have been met and the applicant has demonstrated that, because of the nature or volume of the waste material and the manner of management applied, the facility will pose no danger to the health and safety of persons living in the vicinity of the facility. In addition, the applicant shall demonstrate that the facility is to be located or operated in an area where the proposed waste material activities will not be incompatible with existing land uses in the area.

In addition to any applicable zoning requirements, a waste material facility shall not be located or operated within any of the following:
(a) Two thousand feet of any residence, school, hospital, nursing home, day care facility, jail or prison;
(b) Any naturally occurring wetland;
(c) Any flood hazard area if the owner or operator of the proposed facility cannot show that the facility will be designed, constructed, operated and maintained to prevent washout by a one hundred year flood or that procedures will be in effect to remove any waste material before flood waters can reach it;
(d) Any area which contains a disproportionate number of environmental hazards.
