933.02. Water rates established.
   All water supplied to consumers of water service by the City, shall be metered and shall be charged for at the following rates:
   (a)   Retail Rates.
   Rates for water consumers, residing inside the Toledo city limits and Lucas County water consumers located outside the boundaries Contract Community service area, shall be based on metered water consumption plus a monthly fixed charge per bill. Consumption shall be based on monthly metered use and billed in increments of one hundred cubic feet at the rates listed below effective January 1st of each year in years 2024, 2025, 2026, 2027:

   (7)   Those water consumers residing inside the city limits who are eligible for the Senior Water Discount Program as specified in subsection (a)(8), and are furnished 667 cubic feet of water per month or less, shall pay a monthly rate which is twenty-five percent (25%) less than the rates established above in subsection Retail Rates (a)(1) and (a)(5). Non-discounted Retail Rates shall apply for all water consumed greater than 667 cubic feet per month.
   Those consumers who qualify for the Senior Water Discount Program and have an eligible total income shall pay a monthly rate for all metered water consumption which is forty percent (40%) less than the rates established above in subsection Retail Rates (a)(1) and (a)(5). An eligible total income shall be a household income that is at or below the poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2).
   Those consumers, including those entered into a landlord tenant agreement, who have an eligible total income shall pay a monthly rate for all metered water consumption which is twenty five percent (25%) less than the rates established above in subsection Retail Rates (a)(1) and (a)(5). An eligible total income shall be a household income that is at or below 200% of the poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2).
   (8)   Consumers eligible for the Senior Water Discount Program shall be any consumer who satisfies all of the criteria immediately below:
      A.   Is receiving service by means of a single meter for a single unit utilized solely for residential purposes that is owned and occupied by the consumer;
      B.   Is the contract holder or spouse of the contract holder for DPU's utility services; and
      C.   Has been certified or whose spouse has been certified by the Director of Public Utilities as being sixty-five years of age or older or permanently and totally disabled at any age. For the purposes of this section, the terms "sixty-five years of age or older" and "permanently and totally disabled" shall be defined in a like manner as provided for in the State of Ohio Homestead Exemption, under Ohio R.C. 323.151.
   (9)   The Senior Water Discount Program shall only apply to charges levied against the permanent residence of the consumer.
   (10)   Consumers eligible for the Low-Income Program shall be any consumer who satisfies all of the criteria immediately below:
      A.   Is receiving service by means of a single meter for a single unit utilized solely for residential purposes and is occupied by the consumer;
      B.   Is the contract holder, spouse of the contract holder, or entered into a landlord tenant agreement for DPU's utility services; and
      C.   Total income has been certified annually by the Director of Public Utilities as being at or below 200% of the poverty guidelines in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2).

   (12)   To use a fire hydrant, a user shall obtain a hydrant meter and permit from the Department of Public Utilities, and shall pay deposit charges and daily rental fees as set by the Director of Public Utilities. Water used shall be paid for at the rates set forth in this section.
   (b)   Contract Community Rates.
   Rates for each Contract Community shall be based on their signed contract and on monthly metered use and billed in increments of one hundred cubic feet at the rates listed below effective January 1st of each year in years 2024, 2025, 2026, 2027:

   (c)   Rates payable.
   The water rates established in the manner and under the conditions, terms and provisions of the preceding paragraphs of this section shall be paid to the City at the office of the Division of Administrative Services of the Department of Public Utilities and shall be due and payable on the date noted on bills submitted for water furnished. The rates established in the preceding paragraphs of this section shall become effective on the date on which the sec tion takes effect, and all billings after that date shall, subject to the provisions of this paragraph, be at the rates established in the preceding paragraphs of this section. When billings rendered after the date on which the section takes effect represent charges for water furnished during a period of time both prior and subsequent to the effective date of the preceding paragraphs of this section, such charges shall be prorated among the applicable rates on a time basis. The Director of Public Utilities shall designate the manner and mode of such prorations. Where billings rendered after the effective date of this section represent only charges for water furnished prior to the effective date, such billing shall be at the rates established by Ordinance 878-84 passed by Council on December 4, 1984.
   (d)   Late payment charge.
    If any water charges, tap fees or miscellaneous charges relating to water service billed by the City are not paid in full on or before the due date, an amount equal to five percent (5%) of the amount billed shall be added to the total owed by the customer.

   (e)   Right to contract.
   Subsection (b) hereof shall not be deemed to revoke any existing contracts for water service to customers outside the City limits, nor impair or impede the City's right and ability to contract for water service outside the City limits under the terms differing from those described in subsection (b) hereof.
   (f)   Rates for areas with pending annexation application.
   Rates for water furnished to consumers outside the City limits for areas where a pending application for annexation to the City is on file with the Clerk of Council's office and such applications are not being delayed by any action of any inhabitant in the area to be annexed, shall be billed as specified in subsection (a) hereof.
   (g)   Reports in compliance with Charter requirements.
   As required by Section 165 of the City Charter, the Director of Public Utilities shall, on or before January 15, 1983, and on or before January 15 of each year thereafter, report to Council in detail in the manner required of private and public utilities in Section 223 of the City Charter. Council in accordance with Section 165 of the City Charter shall act upon the report.

   (h)   Regulations of the Director of Public Utilities.
   The Director of Public Utilities shall make and enforce, and thereafter revise if required, such by-laws and regulations as may be deemed necessary for the safe, economical and efficient management and protection of the water works of the City consistent with the provisions of this chapter. Such regulations may include, but shall not be limited to, provisions for adminis tration of water service accounts, requirements for deposits on accounts, collection of delinquent accounts, write off of delinquent accounts, establishment of service charges, suspension or termina tion of service, establishment of charges and fees for specific services performed by the City pursuant to this chapter, and for the collecting, adjusting, rebating, refunding of water rates determined, computed and billed pursuant to the provisions of this chapter.
