17-105: BILLS; WHEN PAYABLE, DELINQUENCY:
   A.   All bills for water, electricity, sewer, garbage, and all other monthly charges made by the city, shall be payable to the city clerk or such other person as is designated by the city manager at the office of the city clerk on the first day of each month. If a bill is not paid on or by the tenth day of the month following that in which the water, electricity or other services were used, the bill will be declared to be delinquent. A penalty of seven percent (7%) of the amount due on any delinquent bill will be charged, and the city clerk or other designated person is hereby directed to collect such penalty at the time the bill is paid. The utility bill shall not be considered paid in full until any penalties are also paid.
   B.   If any bill is not paid by four o'clock (4:00) P.M. on the fifteenth day of the month, service may be discontinued beginning on the sixteenth day of the month following the month in which the utility service was used. The superintendent of the department, or such other person as the city manager may designate, shall discontinue the city service to the premises after written notice. The utility service shall not be turned on again until all arrearages are paid in full, together with the penalty as above specified for shutting off and turning on the city service.    C.   If the superintendent of the department, or other designated person, goes to the premises to shut off the service and the occupant pays the superintendent or person prior to his shutting off the service, there shall be added to the bill the sum as set by the council for the trip made by the superintendent or person to shut off such services. All bills, penalties and fees collected as hereinabove specified shall be paid over to the city clerk. Nothing herein shall be construed as preventing the city from instituting suit for the recovery of any delinquent accounts.
   D.   The city clerk may not accept payment of a water bill without payment of the sewer service charge, nor shall the clerk accept payment of a sewer bill without payment of the water bill. The failure to pay any utility bill in accordance with subsections A and B of this section shall be grounds for discontinuing any or all of the utility services furnished to the customer whose bill is delinquent.  (2000 Code § 17-105)
