14-401: OPENINGS IN STREETS AND SIDEWALKS; APPLICATION; FEE:
   A.   Any person, firm or corporation desiring to make an opening in a public street or sidewalk of the city, is hereby required to make written application for permit to make such opening with the city clerk of the city, and shall be required to pay the sum as set by the council by motion or resolution to the city clerk as an inspection fee. The city clerk shall transmit the application to the city manager, who shall issue a permit therefor if he thinks the request reasonable under the circumstances, and that the street or sidewalk will be properly and promptly restored. If the city manager refuses a permit, the applicant may appeal within one month to the council; and the city manager shall issue the permit if the council approves the application. The council's decision shall be final. Before the permit is issued, either the city manager or the council may require the applicant to deposit with the city clerk an amount of money estimated by the city manager or council to be adequate to compensate the city for restoring the street or sidewalk properly if the applicant fails to do so promptly. If the applicant restores the street or sidewalk promptly and properly, the amount deposited shall be returned to him.
   B.   It is unlawful for any person, firm or corporation to make an opening in a street or sidewalk without a permit as provided herein. (2000 Code § 14-401)
