A. Curb and guttering will be allowed to be constructed under the conditions in this section.
B. All citizens within a block (defined as 1 side of the street from corner to corner) may apply for a permit to construct curb and guttering. The permit for such construction will be obtained at city hall for a fee as set by the council, to be paid at the time of permit application. The permit will designate the type of curb and guttering, specific dimensions, allowances for drainage, and the means by which the curb and guttering will be tied to the street surface.
C. Those blocks deciding on curb and guttering must ensure that all aspects of the curb and guttering will be completely paid for by the citizens of that block and also must ensure that it is agreed upon by all residents of that block.
D. The curb and guttering must be constructed of cement, must be two feet by six inches by six inches (2' x 6" x 6") and must round each corner.
E. The curb and gutter must be designed to tie in with the street surface in such a way that neither the level of the street nor the street surface itself is altered, unless otherwise approved in the permit.
F. The curb and gutter approval will be given only if the present drainage of intersecting streets is not obstructed. The system by which drainage in the curb and guttering area is to be handled should be specific and should allow for underground springs as well as extensive runoff from large rains or melting snow.
G. Repairs to curb and guttering as well as repair of any area of the curb and guttering that separates from the street surface will be charged to those persons living on the block at time of repair unless determined to be caused by the street surface or maintenance thereof.
H. The ditch surface will be prepared for curb and gutter by the city. Citizens are responsible for backfill from yard to curb and gutter.
I. The city will assist in the planning by request of any citizen groups wishing to construct curb and guttering. (2000 Code § 14-204)
