Any permit issued pursuant to § 22-6-49 of this article shall be displayed in the applicable vehicle so as to be readily readable outside the vehicle at all times during which the vehicle is parked in a space or location to which the permit applies. If not so displayed at a time when the parking would constitute a violation of § 22-6-43 of this subchapter in absence of a permit issued pursuant to § 22-6-44 of this article, it shall not be a defense to a citation for such a violation that such a permit in fact had been issued.

The provisions of this chapter shall be applicable to public off-street parking lots, except as otherwise provided in this chapter and except as to provisions of this chapter that clearly are not applicable to public off-street parking lots.

HANDICAPPED PARKING
(A) The City Council may, by ordinance or by resolution, designate certain parking spaces on public streets or on off-street parking facilities owned or operated by the city as “handicapped parking spaces”. In addition, any person in lawful possession of an off-street parking facility may designate certain parking spaces in the facility as “handicapped parking spaces”. Handicapped parking spaces shall be available for the exclusive use of handicapped or disabled persons whose vehicles display a:
(1) Distinguishing license plate issued to handicapped or disabled persons pursuant to Neb. RS 60-3,113 or any later section covering this matter;
(2) Distinguishing license plate issued to handicapped or disabled persons by another state;
(3) Permit issued to handicapped or disabled persons as provided for in this article of the municipal code; or
(4) Permit issued for a vehicle to transport handicapped or disabled persons as provided for in this article.
(B) All such permits shall be displayed by attaching the permit to the motor vehicles rear view mirror so as to be clearly visible through the front windshield. When there is no rear view mirror, the permit shall be displayed on the dashboard.
(C) All handicapped parking spaces shall be indicated by blue paint on the curb or edge of the paved portion of a street, on a barrier curb in an off-street parking facility, or in the parking space itself, and a sign posted above ground and immediately adjacent to and visible from each handicapped parking space as required by the latest edition of the Manual on Uniform Traffic Control Devices adopted by the Nebraska Department of Roads.

(A) It shall be unlawful for any person to park a vehicle in any parking space which has been designated as a handicapped parking space unless:
(1) There is displayed on the vehicle a form of identification as provided for in § 22-6-47 of this subchapter; or
(2) When the handicapped or disabled person to whom or for whom, as the case may be, the permit is issued will not enter or exit the vehicle while it is parked in the designated space.
(B) If the identity of the person who parked a vehicle in violation of this section cannot be readily determined, the party in whose name the vehicle is registered shall be held prima facie responsible for the violation.
(C) If there is posted above ground and immediately adjacent to and visible from such handicapped parking space, a sign which clearly and conspicuously states the area so designated as a “tow-in zone”, then a vehicle not displaying the proper permit or distinguishing license plates may be removed. The removal may be by the owner or person in lawful possession of an off-street parking facility, after notification of the Police Department. As to on-street parking and city-owned off-street parking facilities, the removal shall be by the city.

The City Clerk may take an application from a handicapped or disabled person or temporarily handicapped or disabled person who resides within the city, or his or her parent, legal guardian, or foster parent for a permit which will entitle the holder thereof or a person driving a vehicle for the purpose of transporting such holder to park in handicapped parking space. For purposes of this section, the handicapped or disabled person or temporarily handicapped or disabled person shall be considered the holder of the permit.

A person applying for a permit or for the renewal of a permit shall complete an application, shall provide proof of identity, and shall complete the application and medical forms provided to the City Clerk by the State Department of Motor Vehicles. The City Clerk shall submit to the Department of Motor Vehicles the name, address, and license number of all persons applying for a permit pursuant to this section.
