§ 9-902. Abortions. 1002
   (1)   No person, firm, professional association, clinic or corporation, whether engaged in activity for profit or not, shall offer, demand, obtain or receive compensation, directly or indirectly, from any physician, group of physicians, clinic, or hospital, for referring patients for the purpose of performance of an abortion.
   (2)   No physician, group of physicians, clinic or hospital may offer to pay, or pay, directly or indirectly, any portion of the compensation received for the performance of an abortion as a referral fee, to any person, firm, professional association, clinic or corporation, whether engaged in activity for profit or not.
   (3)   Penalties. Any person violating this Section shall, upon conviction be subject to a fine of not more than three hundred dollars ($300).
   (4)   Repeat Offenders. Any person who commits, on more than one occasion, a violation of this Section, shall be guilty of a separate offense of Repeat Violation, and for each Repeat Violation, shall be subject to a fine of not more than three hundred dollars ($300), or imprisonment for not more than ninety (90) days, or both. A person shall be guilty of a Repeat Violation regardless whether the second or subsequent violation occurs before or after a judicial finding of a first or previous violation. Each violation, after the first, shall constitute a separate Repeat Violation offense.
