PURCHASING
§ 37.01 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CONSTRUCTION. Building, altering, repairing, improving, or demolishing any public structure or building, or making improvements of any kind to public real property. CONSTRUCTION does not include the routine operation, routine repair, or routine maintenance of existing structures, buildings, or real property.
   CONSTRUCTION-RELATED SERVICES. Those services involving construction design, layout, inspection, support, feasibility or location study, research, development, planning, or other investigation study undertaken by a construction agency concerning construction or potential construction.
   NEGOTIATION. The process of selecting a contractor other than by competitive sealed bids, multi- step sealed bidding, or competitive sealed proposals, whereby the city can establish any and all terms and conditions of a procurement contract by discussion with one or more prospective contractors.
   PERSON. Any business, public or private corporation, partnership, individual, union, committee, club, unincorporated association or other organization or group of individuals, or other legal entity.
   SUPPLIES. All personal property, including but not limited to equipment, materials, printing, and insurance, and the financing of those supplies.
