   905.01 STREET EXCAVATIONS PERMIT REQUIRED.
No person, firm or corporation shall open or cut into any street within the City whether paved or unpaved, without first obtaining a permit to do so from the Director of Service.
(Ord. 251.)
   905.02 DEFINITIONS.
As used in this chapter, certain terms are defined as follows:
   (a)   "Permanently paved streets" means and includes all streets within the corporate limits of the City which are paved with brick, sheet asphalt, asphaltic concrete, macadam, asphalt block or bitulithic material and streets surface-treated with road tar and road oil.
   (b)   "Unpaved streets" means and include all gravel and clay streets which have not been surface-treated.
(Ord. 251.)
905.03 INSTALLATIONS BY OPEN CUT; TUNNELING CASH DEPOSIT.
Any person, firm or corporation possessing a permit required under Section 905.01 shall make all installations of any character by open cut or by driving pipe of sufficient size between cuts to permit such installations. No tunneling shall be permitted on any street in the City unless the permittee protects the City from future settlement of paving caused by such tunneling by making a cash deposit to cover the cost of replacement.
(Ord. 251.)
   905.04 BACKFILLING.
The permittee shall backfill the excavation as required by the Director of Service, and the backfill material shall be thoroughly compacted.
   905.05 SURFACE REPLACEMENT AND COST.
The City shall either supervise the replacement of the surface or replace the surface of the street and charge the permittee the actual cost for materials and labor as determined by the Director of Service.
   905.06 MINIMUM STREET CONSTRUCTION REQUIREMENTS.
   (a)   The following pavement standards for the various classes of streets are hereby adopted by the City:

Item 304 Aggregate Base
Item 301 Bituminous Aggregate Base
* For total asphalt pavements, the substitution of 1-inch of Item 301 for each 2 inches of Item 304 will be allowed.
The required pavement sections shall be constructed on a compacted subgrade that has been rolled until it is compacted to at least ninety-five percent of the subgrade material's maximum density at optimum water content based on AASHO Designation T-180-57 Test Methods.
The required pavement sections, together with diligent control in the field of subgrade compaction, trench backfilling materials and procedures, and pavement construction are designed to provide the City with relatively low maintenance cost street pavements.
(Adopting Ordinance)
   (b)   For the determination of compaction and density of the pavement, the City may take core samples of the pavement. Holes in pavement left by core samples shall be replaced by the developer at no extra compensation. If core tests are positive, the cost shall be paid by the City, and if negative, the cost shall be absorbed by the developer.
   (c)   The final street surface course, at the option of the City, may be applied one year later to allow for settling.
