(a) No street, alley or way within the City shall be a public street, alley or way nor shall the Municipality be charged with the care, control, maintenance or repair of the same except in accordance with and on the terms and conditions prescribed in this Chapter and unless such street, alley or way shall either:
(1) Have been accepted or opened by ordinance of Council;
(2) Otherwise have attained the legal status of a public street, alley or way prior to the effective date, of this Chapter; or
(3) Become a public street, alley or way by virtue of adoption and recording of a plot in accordance with the statutes of the State.
(b) No officer, employee or department of the City shall accept, lay out, open, improve, grade, pave, curb or light any street, alley or way within the City unless the same shall be a public street, alley or way as set forth in subsection (a) hereof.

Except in the event of emergency and for the duration of such emergency only, no officer or department of the City and no person, corporate or individual, shall open, permit to be opened, use or travel upon unopened streets, alleys or way, or streets, alleys or ways improved for travel within the City, unless and until such grading, draining, paving and installation of utilities as Council may by ordinance or resolution declare to be necessary shall have been performed, constructed or provided for in accordance with this chapter.
