The city has leased its water and sanitary sewer systems to the Okemah utilities authority, a public trust. The trust has power to set water and sewer rates and otherwise to regulate the water and sewer systems. The motions and resolutions adopted by the trust replace ordinances which the city has relating to these matters. For the motions and resolutions passed by the public trust, refer to the minutes of the Okemah utilities authority. For ordinances adopted by the city related to water and sewer systems, see the provisions of this title. A copy of the trust indenture for the Okemah utilities authority shall be and remain on file in the office of the city clerk. (1985 Code § 17-101; amd. 2007 Code)
The Okemah utilities authority is hereby granted the right and authority to make and promulgate reasonable rules and regulations concerning the use by the public of the sewer and water facilities and to provide reasonable charges for all services rendered. It is further granted all necessary powers to ensure that the utilities are so utilized as to provide for proper compliance with the terms of the bond indenture heretofore entered into and authorized by the voters of the city by which the facilities were constructed. Any violation by any person, firm or corporation of any of the reasonable rules and regulations promulgated by the Okemah utilities authority shall be punishable as provided in section 1-4-1 of this code. (1985 Code § 17-103)
