§ 1-07 Civil Penalties.
   (a)   Any violation of these rules shall subject the respondent to a civil penalty which may be recovered in a proceeding before the Office of Administrative Trials and Hearings, pursuant to Section 1049-a of the Charter. Such proceedings will be commenced by the service of a civil summons returnable to the Office of Administrative Trials and Hearings in accordance with such section. The Office of Administrative Trials and Hearings may impose the penalties in the following table below for violations of the Department's rules.
   (b)   In addition, except as otherwise provided below, violation of the rules of this chapter shall also constitute an offense (classified as a "violation" under the Penal Law), which may be punished in a separate court proceeding by imprisonment of up to one day or a fine of not more than $200. Violations marked with an asterisk are also misdemeanors prohibited by § 18-146 or § 18-147 of the New York City Administrative Code and are subject to additional penalties.
   (c)   "Default penalty" shall mean the penalty imposed by the Office of Administrative Tribunals and Hearings acting, pursuant to Section 1049-a of the Charter of the City of New York in accordance with subparagraph (d) of paragraph one of subdivision d of Section 1049-a of such Charter.
