(A) The consumer shall, upon notification, as defined in § 56.38 of this chapter, install the hazard containment device(s) as required within 90 days from the date of notification.
(B) If, after expiration of 90 days, the containment device(s) has not been installed in conformance with standards set by the Town of Murphy, in a proper working condition, the Town of Murphy may discontinue the public water supply service at that premises, and service shall not be restored until such devices have been installed. The Town of Murphy may permit an extension of up to 90 additional days if compliance efforts are underway and the existence of hardship can be demonstrated.
(C) The Town of Murphy shall bear no liability for direct or consequential damages proximately caused by the discontinuance of service pursuant to this section.

(A) All new construction plans and specifications, when required by these specifications, or by the North Carolina Building Code, to have cross connection control devices, shall be made available to the Town of Murphy for review and approval and to determine the degree of hazard.
(B) All backflow prevention assemblies shall be installed in accordance with these specifications and/or in the latest edition of the North Carolina Building Code, whichever is most restrictive.
(C) All backflow prevention assemblies shall be installed in accordance with the manufacturer's instructions.
(D) All backflow prevention assemblies connected to piping two and one-half inches in diameter or larger shall be provided with gate valves on each side of the backflow prevention assembly. Each of these gate valves shall be operated by an outside screw and yoke assembly with a hand wheel. Non rising stem gate valves will not be acceptable.
(E) In the event of a conflict between a manufacturer's instructions for installation and the North Carolina Building Code, the North Carolina Building Code shall prevail. In the event of a conflict between these specifications and a manufacturer's instructions for installation, these specifications shall prevail, unless judged otherwise by the Town of Murphy.
(F) All double-check valve assemblies must be installed in a location in which no portion of the assembly can become submerged in any substance under any circumstance. Pit and/or below grade installations are allowed if adequate drainage is provided with prior inspection of the proposed site and approval from the Town of Murphy before device is installed. Double-check valve assemblies may be installed in a vertical position with prior approval from the Town of Murphy, provided the flow of water is in an upward direction.
(G) Reduced pressure principle backflow prevention assemblies must be installed in a horizontal position and in a location in which no portion of the assembly can become submerged in any substance under any circumstance. Pit and/or below grade installations are prohibited.
(H) All backflow prevention assemblies installed out of doors shall be provided with a weatherproof enclosure, which is capable of preventing freezing of these backflow prevention assemblies and any related valves and piping.
(I) The customer is responsible to make sure a backflow prevention assembly is working properly upon installation. The consumer shall, at his own expense, conduct testing of a backflow prevention assembly. Tests shall be conducted within ten days of installation, and annually thereafter, with a record of all testing and repairs retained by the consumer. Each consumer shall send a copy of the test report, certified by the Cross Connection Coordinator, for each test to the town within 30 days after the completion of each test. The consumer is required to furnish the following information to the Town of Murphy on each test report for the following types of backflow prevention assemblies:
(1) Types of assemblies requiring test reports:
(a) Double-check-detector assembly (DCDA)
(b) Double-check valve assembly (DCVA)
(c) Pressure vacuum breaker (PVB)
(d) Reduced pressure principle detector assembly (RPDA)
(e) Reduced pressure principle backflow preventer assembly (RP)
(2) Information required in a test report:
(a) Service address where assembly is located.
(b) Owner (and address, if different from service address).
(c) Description of assembly's location.
(d) Date of installation.
(e) Installer (include name, plumbing company represented, plumber's license number).
(f) Type of assembly and size of assembly.
(g) Manufacturer, model number, serial number.
(h) Test results/report.
(J) When it is not possible to interrupt water service, provisions shall be made for a parallel installation of backflow prevention assemblies. The Town of Murphy will not accept an unprotected bypass around a backflow preventer. Any and all bypasses shall be locked and metered.

TESTING AND MAINTENANCE
The consumer at each property at which containment and/or confinement device(s) have been installed, except those with devices installed in accordance with § 56.21(A) of this chapter, shall have each containment and/or confinement device(s) tested on an annual basis, and perform any routine maintenance to such device as recommended by the manufacturer, and provide the Cross Connection Coordinator with a report of that inspection and work. The consumer shall cause such maintenance, or repairs to be made, rendering the device fully operational. Failure of the consumer to perform that testing and maintenance shall be cause for the premises to be deemed an immediate public health hazard. The Town of Murphy may immediately thereafter discontinue public water supply service to that premises and service shall not be restored until such devices have been rendered operational. Where the use of water is critical to the continuance of normal operations or protection of life, property, or equipment, duplicated containment or confinement devices shall be provided by the property owner to avoid the necessity of discontinuing water service to test or repair the device or devices.

Backflow prevention assembly tests shall be conducted upon installation and annually thereafter or at a frequency established by the Town of Murphy. All RPZ, DCVA, and DCDA installations are required to be tested by a certified back-flow prevention assembly technician within ten days of installation.
