1361.01 DEFINITIONS.
   The following words and phrases when used in this Chapter 1361 shall mean the following:
   (a)   "Vacant Dwelling" means a dwelling, as defined in Section 1123.03(b)(30) of the Codified Ordinances, that is not occupied by its owner, lessee or other person in lawful possession, or at which substantially all residential occupancy has ceased, or which is substantially devoid of content. Residential occupancy does not cease when an owner occupies a dwelling for a minimum of five (5) months each calendar year and resides in another dwelling outside of the Village of Moreland Hills, provided that such owner returns to the dwelling and the owner or the owner's agent maintains the dwelling in compliance with all applicable Codified Ordinances.
   (b)   "Owner" means an owner of the freehold of the premises or any lesser estate therein, a mortgagee, a vendee-in-possession, assignee of rents, receiver, executor, trustee, lessee, agent or any other person, firm or corporation that is in control of a vacant dwelling.

1361.02 FINDINGS AND PURPOSE.
   (a)   Village Council, noting the number of vacant dwellings within the Village, an increase in the number of mortgage failures and foreclosures, and information provided to the Council by the Building Inspector, has concluded that vacant dwellings are frequently not maintained and that the deteriorating effect of vacant dwellings are a public nuisance that materially affects the public health, safety, and welfare.
   (b)    Village Council has concluded that a vacant dwelling registration program requiring vacant buildings to be in substantial compliance with Village ordinances before re-occupation will further the public health, safety, welfare, and quality of life for all Village residents.
