5-2-1: PURPOSE:
This chapter shall be liberally construed to the end that the health, safety, and welfare of the people of the Village may thereby be protected and, to the end to provide harmonious relationships in the interaction between man and animals by:
   A.   Protecting the citizens of the Village from rabies by specifying such preventive and control measures as may be deemed necessary;
   B.   Providing security to residents from annoyance, intimidation, and injury from dogs and other animals;
   C.   Encouraging responsible pet ownership;
   D.   Providing for the assessment of penalties for violators and for the enforcement and administration of this chapter. (Ord. 747, 1-8-1992)
5-2-2: DEFINITIONS:
ADMINISTRATOR: The animal control officer hereafter defined.
ANIMAL: Any live vertebrate creature except man.
ANIMAL CAPABLE OF TRANSMITTING RABIES: All animals classified as mammals.
ANIMAL CONTROL OFFICER: The Chief of Police of the Village or other employee appointed by the Village President who is to exercise police powers in the enforcement of this chapter.
BIRD: Any flying vertebrate that is covered with feathers.
BITE: Seizure of a person with the jaws or teeth of any cat, dog, or other animal capable of transmitting rabies so that the person so seized has been wounded or pierced and further includes contact of the saliva of such cat, dog, or other animal with any break or abrasion of the skin.
BOARD: The County Board of Will County, Illinois.
CAT: All members of the classification, Felis catus.
CONFINED: The restriction of the cat, dog, or other animal at all times by the owner in a manner that will isolate the cat, dog, or other animal from the public and other cats, dogs, or other animals.
CONTROL: Any owned animal that is either secured by a leash or lead, or within the premises of its owner, or confined within a crate or cage, or confined within a vehicle, or on the premises of another person with the consent of that person.
DANGEROUS DOG: Any individual dog which when either unmuzzled, unleashed, or unattended by its owner, or a member of its owner's family, in a vicious or terrorizing manner, approaches any person in an apparent attitude of attack upon streets, sidewalks, or any public grounds or places.
DOG: All members of the classification Canis familiaris.
DOMESTIC ANIMAL: Any animal which has been domesticated by man so as to live and breed in a tame condition.
ENCLOSURE: A fence or structure of at least six feet (6') in height, forming or causing an enclosure suitable to prevent the entry of young children and suitable to confine a vicious dog in conjunction with other measures which may be taken by the owner or keeper, such as tethering of a vicious dog. Such enclosure shall be securely enclosed and locked and designed with secure sides, top and bottom and shall be designed to prevent the animal from escaping from the enclosure.
GUARD DOG: A dog used in a commercial business or by a municipal or police department for the purposes of patrol and protection.
GUIDE DOG: A dog trained by a recognized organization to lead the legally blind or hearing impaired.
IMPOUNDED: Taken into custody and placed in a public pound or other suitable place in the county where the vicious dog is found.
INOCULATION AGAINST RABIES: The injection of a rabies vaccine approved by the Illinois department of agriculture and administered by a licensed veterinarian in accordance with the company's recommendations for the vaccine used.
OWNER: Any person having the right of property of an animal, who keeps or harbors an animal who has it in his care, acts as its custodian or who knowingly permits an animal to remain in or about any premises occupied by him unless possession is prohibited by federal or state laws. Native wildlife remaining on or about any premises shall not be included in this definition.
PERSON: Any individual, firm, corporation, partnership, society, association, or other legal entity, any public or private institution, municipal corporation, unit of local government or any other business unit.
POUND: Any facility licensed by the Illinois department of agriculture and approved by the administrator for the purposes of enforcing this chapter and used as a shelter for seized, stray, homeless, abandoned or unwanted animals.
RUN LINE: A system of tying a dog in place with either rope or chain having a tensile strength of at least three hundred (300) pounds.
STRAY ANIMAL: Any animal that is not controlled by leash or other recognized control methods, or confined within the real property limits of its owner.
VICIOUS DOG: A. Any individual dog that when unprovoked inflicts bites or attacks a human being or other animal either on public or private property;
   B.   Any individual dog with a known propensity, tendency or disposition to attack, without provocation, to cause injury or to otherwise endanger the safety of human beings or domestic animals;
   C.   Any individual dog which attacks a human being or domestic animal without provocation;
   D.   Any individual dog which has been found to be a "dangerous dog" upon three (3) separate occasions;
   E.   No dog shall be deemed "vicious" if it bites, attacks, or menaces a trespasser on the property of its owner, or harms or menaces anyone who has tormented or abused it, or is a professional trained dog for law enforcement or guard duties. (Ord. 747, 1-8-1992; amd. 1999 Code)
