5-2-11: IMPOUNDMENT FEES AND PENALTIES:
   A.   Impoundment Fees:
      1.   Fees Established: The following fees shall be charged and collected for any dog, cat or other animal impounded under the provisions of this chapter. In addition, for each day or part thereof, that such animal is sheltered, reasonable and customarily accepted board fees shall be charged by the veterinarian and paid by the owner prior to release of the animal.

      2.   Accumulation Of Offenses; Fees Added To Penalty Fine: The offenses shall be accumulated over the period of the last twelve (12) consecutive preceding months in determining the number of offenses for the above purposes. Said fees shall be added to any penalty fine if a citation is issued for violation of this chapter and the animal is not redeemed.
   B.   Redemption: The following provisions shall apply to redemption of impounded animals:
      1.   Payment Of Fees: Any person desiring to redeem any dog, cat, or other animal impounded under the provisions of this chapter shall be entitled to do so by paying all fees which have accrued due to the impounding of such dog, cat, or other animal as of the date of redemption, and, in the event such dog or cat has not been licensed, obtaining a license for such dog or cat pursuant to the applicable provisions of this chapter. Any animal impounded under this chapter and which this chapter declares it to be unlawful to keep within the village, shall upon redemption be immediately removed from within the village limits, properly restrained so as not to damage property or person.
      2.   Disposal Of Unredeemed Animals: Any dog, cat or other animal not redeemed by his owner may be disposed of in accordance with state law. If no state law applies to the disposition of a particular animal impounded, any such animal not redeemed by its owner within ten (10) days after impoundment, where the owner or keeper is unknown, or within ten (10) days of notification of the owner or keeper where known, may be redeemed by any person paying the required fees, or released to an animal welfare agency or destroyed in a humane manner.
   C.   Penalties: Any person who violates any of the provisions of this chapter shall be subject to fines as follows:
      1.   A fine in the amount of twenty five dollars ($25.00) for each offense, provided said fine is paid within seven (7) days from the date of issuance of a citation for violation of this chapter, and the sum of fifty dollars ($50.00) if paid after said seven (7) days and prior to hearing.       2.   Upon a hearing on any such violation, the fine shall be as determined by the court, but not less than fifty dollars ($50.00) nor more than the maximum fine provided for in section 1-4-1 of this Code.
      3.   The above fines shall be in addition to any fee charges for impoundment and shelter under the provisions of this chapter, should the animal be impounded. (Ord. 747, 1-8-1992; amd. 1999 Code)
